Darlington sex offender running from accusations similar to charges he faced before (Hartsville) March 17, 2006 - The search continues for a man who authorities say raped two girls. It's a crime he's been convicted of before, and he is registered in the state sex offender registry . 15 years ago, Kenneth Glenn Hinson sexually assaulted a 12-year-old girl.
The arrest warrant says Hinson held a knife to the girl's throat and threatened to kill her if she told anybody. That year he was sentenced to 18 years in prison. He got out after serving nine.Hinson's case has outraged the state's attorney general, Henry McMaster, "We ought to abolish the parole system 100 percent for all crimes. Put real truth in sentencing into effect. And if the judge doesn't think someone ought to get 18 years, then let him give him nine years." The allegations of the two rapes this week have Hinson's family asking questions. Hinson's niece, Renee Faile, says, "I thought he had changed and now I guess it's different. I don't know if he's any different. I don't know if he relapsed. It's six years since he got out, so I don't know if he just relapsed." Officials say Hinson kidnapped two 17-year-old girls, brought the two victims to a space he created under a shed, tied them up, sexually assaulted them and then left them there. Faile says she now knows why her uncle spent almost every day in that shed, "No one would go out there messing with him because it was his area, and we would leave him alone." Investigators say Hinson isn't related to the teens, but they were neighbors. Hinson left them in the underground cavity and shut the door. Investigators say the teens were in there for about seven hours. They suspect if the girls were in there much longer they could have suffocated. Sometime early Tuesday morning, the girls got out of the tape, kicked through the door and made it to a road where they flagged down someone for help. The passerby picked them up and took them to a relative's house where they called authorities. The sheriff's department returned to scene and discovered Hinson fled on foot. A chain of events like this is something that some experts actually predicted when they let Hinson out of jail. The Department of Corrections tells News 10 an inmate's time behind bars depends on how well they behave and how hard they work. James Brennan with the Department says during the years Hinson spent in jail he worked consistently and never got into any trouble. In the year 2000, two different review teams found Hinson would probably engage in acts of sexual violence if not confined in a secure facility for long-term care, control and treatment. But after testimony from witnesses, as well as a mental health evaluation, a judge rejected Hinson for the program.Judge Edward Cottingham wrote the state failed to demonstrate probable cause. McMaster says, "I think an error was made by the judge in this case. This man should've been kept in the system. If so, then this would not have happened." WIS' Heather Brown talked with Judge Cottingham by phone Thursday. He said he does not remember the specific case. He said the official court records should reflect the basis for his ruling. The case is six years old so the transcript should be stored on tape at the Darlington Courthouse. If it's there, you can count on WIS to obtain a copy of that transcript and continue following this story, as authorities continue to look for Hinson. Investigators are currently pursuing all leads, working federal and local agencies to catch him. So far, agencies involved in the search include the Darlington Co. Sheriff's Department, Hartsville Police, SLED, SC DNR, US Marshals, Kershaw County Sheriff's Department, Chesterfield County Sheriff's Department and the Highway Patrol. Deputy US Marshal Tim Stec said that Hinson was spotted Wednesday night near the Darlington-Chesterfield county line, but investigators were not able to catch him. On Thursday evening, Darlington Co. authorities say they had reports of a possible sighting in Hartsville and Kershaw. The leads were checked out and cleared, night vision goggles and thermal heat technology were used to search. Stec says investigators think Hinson is armed, on foot and still in the area. Kenneth Glenn Hinson is described as a white male, approximately 6'1" tall and weighing about 155 pounds. He has blue eyes and brown hair. If you have any information regarding the whereabouts of Hinson, you're asked to call the United States Marshals Service at 843-662-0750 or 803-765-5477, or the Darlington County Sheriff’s Office at 843-398-4501. The US Marshals Service is now offering a $10,000 reward for Hinson's capture. What I wrote was that any idea supported by Fox "News" or O'Reilly was even less likely to be a good one. Although, I am against mandatory sentencing guidelines in any form, since I feel it violates the separation of powers. But, as I noted before, conservatives tend to be for only those portions of our democracy that allow them to implement their policies, so that's fairly consistent for them.

I don't want the legislature telling the courts what to do any more than I want the courts telling the legislature what to do. It's called SEPARATION of powers for a reason. See, I have certain principles that remain consistent, even when they result in a specific policy I don't like. Plus, I don't like any judicial system that might result in the death of innocent people. When that happens, they call it murder, and if you support it you're complicit in it.
