If I buy a walkman in Walmart and sell it at my yardsale that is not illegal nor copyright infringement. If I buy a Rolling Stones CD from a store and sell it at my yardsale that is not illegal nor copyright infringement either. If a friend gives me either of the above items and I sell them in my yard sale there is nothing wrong with that. If I find those items on the side of the road, nothing is wrong with selling them either. How is this different? If I aquire an item in SL (free or paid for), I should be able able to sell it or give it away (as long as the item is "trans" -- which is EXACTLY the mechanism creators already have to stop this from happening if they do not want the new owner to have those freedoms) In RL we donot have creator based items.They are sold from companies.This is the reason why we have warrenties,patents and other things.If you were to upload and sell the material off of the CD you are breaking the law. You buy the item and can resell said item at a lower price.If you are reselling items at a higher rate than what was bought and/or selling mass ammounts of "used" items that is breaking the law.When having a yard sale each city sets rules and limitations for their people.To sell items in a yard sale is being a transient merchant. Under the laws if an officer were to come and say you cannot sell said items you under the law have to remove items and failure to do so with cause you to get fined. Now with internet content it is much harder to police and maintain copyright content. But,if a creator DOES see their free or even trans items being sold at or higher than the price they were sold that is infringment of copyright laws. You must abide by the TOS ,failure to do so can cause problems. Creators CAN take legal action against said violators due to the nature of this game. In all actuality this "game" holds real currency and real businesses. People do come here to create and sell their items for real currency. If real currency was not part of this game then copyright laws with obviously not be in place. The copyright law in this game is to protect those people who do sell their items. And to go against it is breaking the law. |

No I think it's just that the originator of this post is someone who doesn't like to see people making money off of the work of others by exploiting those that don't know any better If the person selling the items in question really was selfless and concerned about helping new players, then this wouldn't be an issue because she wouldn't be selling items to them that she could just give away.By the way, do you even know what the word ignorant means? ig·no·rant adj. 1. Lacking education or knowledge. 2. Showing or arising from a lack of education or knowledge: an ignorant mistake. 3. Unaware or uninformed. It seems to me that Surreal knows exactly what's going on. Go ahead, go out and buy some CDs and then set up a shop in front of your house selling copies of them all day long. And see how long it takes for the cops to be called. Several people missed the point. I'm selling the ORIGINALS at my yard sale. (not making illegal copies - yes... copies ARE illegal) read my follow-up post which gives 3 reasons some content creators are upset with other people selling their "meant to be free" items. (which they DID set to be copy and trans by choice) |
