Anyway, you know now that this mess here over this one parcel is a week old, Jack said it was a problem that should be resolved then it was. Mainland is slightly better, you still have a parcel in the region just now its in the corner out of the road so what good are you doing yourself by demanding a move into the middle of a plot?


Weedy is not disciplinary banned. In fact, I am ARing this post as yet another constructed defamatory accusation toward Weedy.

The point is... you have been an asshat and we refuse to deal with you until you show some balls and own resolve the issue with Weedy. That wasn't good enough for you though, oh no.... somehow you managed to bilk enough Lindens to take our land without notification.

Who the hell are you to demand special attention like that? There are 1000s of plots owned by griefers and extortionists, but LL wont trade them on anyone's behalf.

Well, I don't have much choice. :) While I would like to believe that I am omniscient in some form, I can't claim it in this case. ;)

Oh, I would probably feel pretty rotten over it. However, I wouldn't then turn around and go piss on my neighbors because of it. It wasn't their fault. I suppose I would instead get together with a bunch of people who can help me gang up on LL to get it recognized and addressed. I'd also make effort to be DAMN sure that it ultimately wasn't because of my own problems in addressing issues with other people.

I always try to start out nice, even with asshats (at least in person/private), but if people insist on being rotten, I can play that game, too. However, when it comes to business, sometimes professionalism is the only answer, and that means biting your tongue and just moving on, because it just isn't worth the fight.

It's the new policy. I've had it done to get extortionist holes out of my land. Quite a few others have as well. Will become the norm as time goes on.

In the Arbor Group, Ewan openly accused us of "causing the adfarm problem" and "they never trade plots" He has a vendetta with Weedy because she refused to cave into his demands. Nothing more.

Instead he has embarked on this path of constructive defamation and manipulating his land to produce wrongful abuse reports against us.

As a side note if someone wants to buy this now infamous parcel (65520m 14996 prims- wee bit of water on the plot mature rated) they can do so at the bargain price of L$360,000.

One of the neighbours isn't much cop though to be honest :D

One other salient point:

Even if one is an asshat, if one is in the right, then there's really no argument.

I mean, if you ran me down with your car whilst I was on a bicycle, I have every right to sue and recover damages, no matter how much I curse and swear at you for it. Not saying that is the case here, just the general principle.

Here you go folks, this guy broke numerous rules to defame our group, embarked on a constructed abuse report campaign by manipulating his land, demanding we turn over our land under his terms and continues to lie about Weedy and our group.

Now he is crowing about it here in the forums.

He's worse than any adcutter.

If none of this ever happened, the answer is yes.

Initially we did not know Ewan from Adam, if he had done so from the outset, there would have been no issue. We would have handled his request like any other.

It's both offensive and wrong for anyone to think we singled him out for no reason.

He demanded and we responded with our policy, but that wasn't good enough for him.

So, basically, what you are wanting is Ewan's contrition on handling, right? We both know that LL isn't going to do or say anything in response to it, especially posted in here. LL doesn't even read this forum anymore. So that is going to be a non-starter.

Ewan got what he wanted, which you would have granted to him anyway. You're both adults, so there's no harm in both of you burying the hatchet and just shaking hands and letting it go, right? If not, what else do you want?

Actually, I believe they reserve that right in the TOS, regardless of how many years you've "owned" their property. I could not find a specific, but the below language sounds close to such.

If Ewan, in his note to me the other day, apologized for the way he dealt with Weedy, or at best even attempted to show some contrition, perhaps. But when I logged in and saw the request, Weedy informed me was muted. I attended the land, removed the script and smoothed the terraform, until which time Ewan had the opportunity to resolve it.

I was suspicious of his terraforming tactic, so for our protection, took a snapshot of the land. The land needed to be lowered to match his. So I did that, but when I returned a day later, the land was raised to highest level, giving our plot an appearance of being a hole. I'll bet you a dollar to a donut, he abuse reported us for that.

And you wonder why we won't deal with him?

Actually no, while that might be a boiler plate rule, nobody can be banned without notice, nor can land be taken without notice where no rules are broken. We own rights to the land and paid for it. Anything otherwise is breech of contract. (not to mention the intervention by LL into a dispute between residents). The TOS applies to Linden Lab too, as to real world trade practices and principles.

Even in the case of Bragg v Linden Lab, where Bragg deliberately defeated an auction process. LL was still obligated to return the land.

We never did anything wrong to have our land arbitrarily taken from our group.

Again, I wasn't there nor privy to the reality of the situation, but it would seem to me that, no matter what, if someone got snotty about wanting your plot, it would seem to be more profitable to deflect it in the direction you want it to go.

"Greetings. I am afraid we cannot sell any of our plots at this time, but we are glad to trade for another parcel of the same size in the same region. If this is acceptable, please provide the location of the plot you would like to trade with us and we will be glad to transfer the current one to you once we have secured its replacement."

I watched the Arbor Group chat during that incident and what Weedy said were not coming from an angel's lips. If anything, I would call that little clash a draw.

EDIT: I was shocked!

Over a year ago, I asked to trade plots in Mocis with your group, but was refused because I was told that the Blue Button Holding 16sqm plot was on roadside and what I had to trade was not worth as much. Even though I could have given trade to other roadside, SLRR - side, Protected Ocean side or a sim border. It was viewed as a trade for lesser value and no deal was made. If Blue Button Holding just needs 1 16 plot in every sim for whatever in the world they do, then what does it matter where it is?

Never once did Ewan ask weedy for a trade, ever.

He started with a demand that Weedy GIVE him the land. When she explained to him our policy, he refused to accept it.

That's when he put a huge building with a tiny door, and AR'd us for "blocking him" He admitted that to her and she inspected the plot.

I will say it again and again, he didnt get his way, and ever since, has embarked on this savage and defamatory attack on our group. Not one word of contrition from him and instead crows about how violating the TOS to attack another resident in good standing is a good thing.

No no, if you had offered roadside for roadside, we would have traded. We do that all the time. This is the excuse Ewan was harping about too, but for your information, we downgrade all the time.

Very very often, our land winds up in the middle of joined plots, we cannot control that, but we can help fix it and the usual alternative is to get parked in some hideous ad plot.

So to suggest we don't trade for lower value is wrong. The reason we don't trade protected land for surrounded land, is our land is often blocked by neighbors, making it difficult sometimes to access our land. Our latest inventories have shown a reduction in these incidents lately, but a year ago...almost 20 percent of our plots had some type of blockage, encroachment or annoyance. That's ALOT of blockage, when you own as many plots as we do.

At the time "value" was the wrong term to use, whereas we should have used "unobstructed access" as the reason. The land value is irrelevant.

If the rules change, and you end up falling afoul of the rule because of the change, then it's not breach of contract. :)

Actually, LL wasn't obligated to do anything. They voluntarily settled the case, the details of which are confidential.

Technically, the land wasn't so much "taken" as "traded", in a manner equitable to terms you would have ordinarily accepted (right?).
