From: Jake Reitveld No. If Agent X is soliciting information and prvidign it to a foreign goverment, then that is espionage. If reporter A does te same thing, then he is guilty of espionage.
If agent x obtains secrete information and puts it in the New York Times, he is guilty of espionage. If Agent X is leaked information from an inisde source, and publishes it in the NYT, then he may not be guilty of espionage.
No reporters should be left loose to run around intelligence agencies. But the blame would be with the leaker, not the reporter.
18 USC 793 (d) provides that a person is guilty of espionage if:
"Whoever, lawfully having possession of, access to, control over, or being entrusted with any document, writing, code book, signal book, sketch, photograph, photographic negative, blueprint, plan, map, model, instrument, appliance, or note relating to the national defense, or information relating to the national defense which information the possessor has reason to believe could be used to the injury of the United States or to the advantage of any foreign nation, willfully communicates, delivers, transmits or causes to be communicated, delivered, or transmitted or attempts to communicate, deliver, transmit or cause to be communicated, delivered or transmitted the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it;" So, you don't think that foreign governments read USA Today? And if the reporter publishes what they know to be classified information which then harms the national security of the United States, are they not guilty even as an accessory? Or is it time for me to call for a change in the law? -Kiamat Dusk

-Kiamat Dusk Well I suppose it is time for you to call for a change in the law. Reporters who report leaked information are not liable, though the leaker may be. The crime is not in the reporitng of it, but in the dissemination of the information. In otherwords, had the leaker not leaked, the reporter would be in no position to publish the information. In short the law is not holding the reporter, who is charged with no duty, liable for the breach of security. Simply knowing that information is classfied does not mean you cannot publish it-other wise all documents would be classified and we would have no news of the governemnt except that which the government allowed. There are also huge first amendment issues with the "chilling" of political speech casued by reporters publishing newsworthy stories based on classified information. The presupposition is that if the government does not what you to know what it is doing, then it is doing something wrong. I suppose also that because the fact is broadcast, it becomes a known issue, and the governemetn can respond and do damage control. If it is clandestinely transferred to another government, then it is more than just embarassing. Baiscally if you want to keep secrets confidential, you better trust your staff and those who have the clearnace to know, to keep them so. Leaking secrets to a reporter means the system has failed already, and the reporter cannot be charged with a duty he or she did not undertake.

From: Jolan Nolan Oh magic Jake-ball, will I ever afford true happiness here on SL before I win a million in RL - Jolan depends on what you call happiness. Personally happiness is an illusion, a statemnt of preferences that ignores the negative aspects of living. Some times ou drink the milk, sometimes you cut your foot on the broken glass, both are part of the whole. You can't have one without the other. True happiness however, is less likely to be found in buying things than in simply doing things. So you do not need to win a million to be happy in SL. Just be in Sl and just be in RL. SL/RL same thing-just be.

Hi Jake
Great thread!!...have a few of quick questions for ya
1. Can good exist without evil? If all the evil were to dissappear would the good expand to fill the void and become the new evil?
or is there no good and evil just nature?
2. Why is the name Siobhan spelt Siobhan but pronounced [sha-vorn]?
3. Why do certain countries drive a different sides of the road?

BTW Jake, when will the Middle East conflicts settle down?

I must say that I'm disappointed that I don't get the chance to spank Kiamat. His begging shows clearly that he needs discipline. However, I did notice that Colette made 2 posts without asking a question. May I be permitted to spank her?

We spank you because you break the rules. Not because you like it. Editing your post to subsequently include a question only works if I don't catch you. You can call for a change in the law, but I don't think it will happen, and I don't think it should happen. Leaking information isa problem with the with the government not the press.

=p Collette is right, but she did not ask a question, and she should know better. I am going to spank her. She loses her spanking privilege for not asking a question this time, and ZuZu you may spank Kiamat.

Dear Jake,
Why do some people act like jerks to other people (name calling, threats, that sort of thing) and then act surprised when the people they are being rude to don't do what they want?

I suppose because people at the core of our being beleive that we are entitled to preferential treatment in everything, without haveing to give anything back in turn. its like the women who want a good man in second life, and then call you an asshole because they are married and you don't play with married women.

Ive noticed this seems a mainly online situation - its like people cant get past the "game" aspect and remember theres a real person on the other side of the screen. the "My av is gorgeous and i like how your av looks and you have lots of linden money so lets get married" .. crowd. Thinks its all like Sims Second Life or something, i guess.
