Anshe's land for sale

Just a small update. Just went in world and flew to Maui. I am corrected, Jauani sold to Anshe and now I am on the ban list. Too rich, she was there and I proudly received my 3 negs Thanks Anshe for making me laugh and giving me my very first negs.

In law the key is intent.

pandastrong's intent was to send a message to Anshe that he didn't care for the forrest of for-sale signs. The damage was a negative rating.

Anshe's intent was to punish him for expressing that opinion. The damage was three negative ratings and several very inconvenient and visually unappealing land bans.

It is a standard case of communication followed by retaliation. Note that the communication properly utilized the ratings system but the retaliation was an abuse of the ratings system. Further the retaliation included an element of griefing by further inconveniencing pandastrong.

If I were a mediator, I would side on the side pandastrong as he used the tools as they were designed and had no malicious intent, which is the exact opposite of Anshe. Further I would allow his negative rating to stand and would require the complete reversal of Anshe's negative ratings, land bans, as well as damages for inconvenience.

I'm not dogmatic adhering to only what is written rather I prescribe to grounded universal morals (categorical imperatives) supplemented with utilitarianism and feminism. Simply because our masters haven't had time to transcribe in detail every nuance which is crime doesn't mean I don't recognize it for what it is.

A slight difference, yes. But, they both originate from negative spaces.

But - you aren't the "law" in SL, or the judge, jury or executioner. Thank God. And, for you to state what another player's "intent" was seems to be rather presumptious. It would be good if everyone would just stick to the facts and not start to assume that they know what another player's motives or intentions are.

I would prefer the average buildings there that average residents in SL usually put on their land.

Well I did prefix my judgment with "if I were the mediator". I'm not so presumptuous as to appoint myself as supreme judge of SL. President of SL maybe but supreme judge? Never.

Also, I'd like to say that speculating on intent is exactly what law is about. That's the whole point of having a jury of one's peers. We go so far as to even speculate on premeditation, punishing those, whom we think planned a crime in advance, more than we do crimes of passion. In this case Anshe's crime was one of passion.

Anshe owns most of the land. Who cares? And if we did care, would Anshe actually change things?

The poll bites. It's obviously purposefully designed to troll. And she called the majority of her customers "average" and opined that they build "average" homes, which sends a clear message about attitudes toward business. Why is there a debate here? You're doing what she wanted you to do.

Ignore this poll and thread, focus directly on issues like griefing through terraforming, banning, etc.

The problem isn't with Anshe, it's with the system. We need to tax land sales or flatten the land tiers to eliminate the financial incentive to exploit or for those who are fiscally well-read we need to add risk and regulation to arbitrage.

Been reading about the Pandastrong Anshe event quite a few times in several threds now.

I wonder if the for sale sign had been anyone elses, would Panda has neg rated?
Maybe Anshe banned him from her land, to teach him use the IM feature, which should have been used in first place. If I do not not like what my neighbout has, I would at least try to solve it by talking before attacking with some lame in game feature.
Maybe banning made Panda use the Im feature, which is alo a built in game tool?

I would probably have done the same as Anshe did, just to see how the rater bounce between the lots. Not for long though, maybe a day or 2 or less if I had gotten an IM where the rater would have shown he is capapble of communicating with words instead of clicking built in game features ( which i belive Anshe showed him she also have).

And to Siggy, there is still a differnce between not letting anyone enter and tricking someone to come in and kill him.

Well unfortunately (as has been mentioned before) using the land banning tools to purposefully hinder another person's access to their land or to lessen their enjoyment of the program is a violation of the TOS.
