Phil, I have taken an image of this post and have three others do the same and save the thread as evidence. I will now give you 24 hours to apologise for what you have written about me in that post here in this thread, publicly for all to see in this thread. If you don't, I will first go to the courts in the UK to have SL give me the information I need to start court proceedings for libel against you. If the British courts cannot manage this because of jurisdiction problems I will use the US courts who will issue a warrant for the information. If SL does not have the information, there will be an audit trail to where the information is. One way or another you will end up in court. Don't make me prove to you that you do not have the right to libel people on a forum. You have stretched my goodwill beyond my limits. Once I have started this process I will not stop. Apologise. You have until 08:00 GMT on the 21st October 2009.

I can't speak for the UK courts; but I do know that the US courts won't touch this with a ten-foot pole. This isn't libel. This is parody. Huge difference. No court is going to go after this for much the same reason nobody goes after Saturday Night Live. But it'll be fun watching you try.

True.

....................

I've been doing some deep and extensive research and I am absolutely taken aback at what I've discovered. So much so that first thing tomorrow, I'm going to start fortifying my own personal fortress against the shape-shifting lizard aliens. In case anything happens to me, I'm posting this here so that at least all of you will have a slight chance of getting away in time - but goodness only knows where to.

No wonder Debra said she doesn't agree with David Icke about the lizards - because she *IS* one of them! How do I know? Because my extensive research led me to decipher their language AND WE'VE SEEN IT RIGHT HERE IN THIS VERY THREAD!!! They don't communicate with different words like we do. They communicate with a single word, but they say it in patterns, because lizards from another world don't have a suitable anatomy to talk like wot we do. The word is .... I hestitate to say it, but I must ..... the word is .....

"blah"

I'm afraid to say that, in her haste to write a number of posts, Debra unintentionally lapsed into writing in her alien lizard tongue, although one of her alien messages was intentional - she was asking if there are other lizards who are reading this thread..

Keep it to yourself! For goodness sakes don't actually speak it out loud or you could be inviting disaster to befall you. Never ever write it down. Let this be the very last time that it is written. If you are ever asked what the word is, say, "mum's the word" and hope they swallow it.
/me analyses Phil's post (several times) to identify anything that might be construed as libel - and fails.

Pep (Unless you believe that suggesting someone else is a bilingual alien lizard is pejorative, as opposed to the great compliment which I would consider it to be.)

Uh oh, now she might have to 'make you regret' that! You, like, totally changed what she said! That is so bogus, Marcel.

I wonder if we might be.......ON A LIST. Does anyone else wnat to be 'on a list'? Other poeple have had lists before, and it sure looked like fun.

Gosh, I wonder if already the legal wheels are turning. Phil got a warning, AND a chance to apologise. Maybe I don't get that, on account of my more heinous act. Whadeva.

So, last night we had heavy rain, and it sounded pretty wild out there. How's it looking for you all?

Don't scoff at the thought of being "on a list". Remember all those frozen humans who were hung up in rows in V? Food storage. How do you think that those particular humans were chosen??? The lizard lady may have influence

Yeah I admit, I was extremely jealous when I did this. You and Phil got threatened, and I did not. I felt left out.

Would I get a chance to apologize? And I I got it, would I use it? Watch it on the next episode of "Thank you SL"!

Debra. How dare you accuse me of libel! That's libel! I have taken screen shots of your post and, if you don't apologise to me within 24 hours, I will consider taking legal action against you. Be warned. Apologise or risk the ignominy of being ordered to pay me compensation.

Ah.. in the course of conducting extensive research on David Icke and The 14 Amendment (well, googling it) I came across something that makes it all clear.. http://www.davidicke.com/forum/showthread.php?t=61516
Brilliant! Just brilliant! I love that article - well, the first part anyway. I was bored before I got to the next part. It really does explain a lot, doesn't it :)

Just out of interest, I've done some more deep and extensive research - this time into libel :) And this is what I found concerning UK law (I'm in the UK as most people here know).

Source: http://www.urban75.org/info/libel.html

From: someone
In the UK, if someone thinks that what you wrote about them is either defamatory or damaging, the onus will be entirely on you to prove that your comments are true in court. In other words, if you make the claim, you've got to prove it!
Is what I wrote about Debra defamatory or damaging? Perhaps. It was so outlandish that nobody in their right mind could actually believe it, and so it couldn't be defamatory or damaging to her. Of course, those who are not in their right mind, like the odd person in this thread, might well believe it, so it could be argued as being defamatory or damaging, albeit only in the minds of those who are not in their right minds, and who are able to read this thread - an incredibly miniscule number of people.

Incidentally, although Google can and does index URLs from this forum, nobody who isn't registered here can read them - not even in Google's cache. So the content of the pages in this forum are private to this forum's users. Debra was wrong about that when she used it against what someone wrote earlier in the thread.

And...

From: someone
You can't defame nicknames when people don't know who they are.
Ah! That's it then. Who the hell is Debra? I'm totally in the clear :D

Debra, my dear, I suggest you save your money ;)

I thought this might be helpful too:

'No actual injury: If there is third-party communication, but the third-party hearing the defamatory statement does not believe the statement, or does not care, then there is no injury, and therefore, no recourse.

In addition to the above, the defendant may claim that the allegedly defamatory statement is not actually capable of being defamatory—an insulting statement that does not actually harm someone's reputation is prima facie not libelous. Also, the public figure doctrine, also called the absence of malice rule, may be used as a defense.'

That's current British law, by the way.

So, we need to establish 2 things here. Firstly, is it possible to actually BE a lizard person, and if so is that a bad thing? And secondly, assuming the first to be established, does anyone here believe that Debra is one?

Otherwise, there is no case to bring. The CPS won't touch it with a bargepole, and a private action whilst technically possible, would likely be thrown out after the opening arguments. With costs against the unfortunate plaintiff.

I say, bring it on!!

Very interesting stuff :)

I'd love to see the face of the CPS person who had this arrive on his/her desk - and those of the ones s/he showed it to :D So it's going to be a civil case. Bring it on, Debra - whoever you are LOL

Libel is a civil matter, not a criminal one, so it's nothing to do with the CPS. Debra will have to instruct a solicitor to act for her, who may well give her certain advice. This will doubtless include the advice that libel has to be committed against an identifiable individual and constitutes something that is likely to damage that individual's reputation with reasonable people.

So the first question is, how many people are able to connect remarks made about giant lizards and Debra Himmel with the person sitting in the solicitor's office, and, even if they do, to what extent is the matter complained about likely to damage the plaintiff's reputation, or will the reasonable person see it as a joke?

And, of course, given the steps Debra's taken, or told us she has, against allowing Linden Labs, the NSA, or whoever to find out who she is in rl, it might be argued that no one is going to be able to connect any remarks made about "Debra Himmel" with anyone in rl.

The delicious irony of this, of course, is that "Debra Himmel" will have to bring this action under her real name.
