Any Land Owners interested in a class action suit?

Where is the 'Duty of Care' ?

I hear so much of the 'TOS' and from a legal point it only works if both sides agree fully. In many cases it is how big business keep us in line. Bottom line is we did agree to the 'TOS' as we entered the game. So we only have ourselves to blame if we didn't read the 'TOS'.

Though I would assume that in return we must also be entitled to some reasonable 'Duty of Care' from LL on our part. They provide the forum and the game and in return receive payment for that.

I would like to think that keeping us happy and active within the game would be their priority. If we are not there, who will pay thier incomes?

Again this is only a comment on my belief that we should be listened to and not pushed aside as if we don't matter. We keep you alive too!

A couple of points to consider:

1) In nearly all class actions, those who 'win' are generally the lawyers. The class action participants tend to get a token award at best.

2) *Pay* a lawyer to cover a class action? If a case is class-action-worthy, most lawyers would be all over it in a heartbeat, pro bono. The amount the lawyers get as a cut of the class action gem would be far far higher than what the class participants would ever pay.

3) The fact that LL is doing *anything* at a reduced price is a shock in of itself. This would make it the first time *ever* that they've stepped back from finding yet another way to squeeze lettuce from their customer base. I personally think there's a catch here somewhere, but still wouldn't make sense (yet) to take steps encouraging them to return to their eager-shill ways.

Well .. if it truly was an unjust thing ..

It would be a ironic and warped bit of justice if the retaliation were organized on the forums or within SL.

You have enjoyed or worked with it or made cash from it for however long you had it

They changed thier prices. Big Deal. Buy a tv last year find the same one on sale this year. TV store didnt rob you. Neither has LL.

Investing in anything carrys risks. If you chose to look at any land purchases as an investment then you assumed the risks when you invested. LL NEVER put a gaurantee you would not lose value in your lands!

Dunno about that. Many people use rent to mitigate or narrowly offset expense. I am guessing I'd be hopping mad if my own expenses were as deep as the cost of a sim, probably increasing exponentially with additional sims.

People are not clever in falling back on the whining thing, no offense, since you have to be smart enough to recognize legitimate complaint, no matter its' result, or else you simply become a cheerful doormat dangling in the wind of anyone with a power over you.

That is a waste of time and money. There are no guarantees about "land" prices, and as for "behavior" unless there is something that LL has done that is absolutely egregious in breaking contracts, you likely won't get anywhere.

SL is a developing platform, and as it matures, costs will go down. So what exactly are you hoping to sue for?

Or maybe insulting. Depending on whether you are one of her targets.

I have been in SL for years, I have spent many hours having fun at Extreme and loved the people and the owners...the excuses that have been given for making the casinos illegal are bogus, Second Life is an adult world and at one time was said to be governed by its members and if you believe that I got a bridge in Brooklyn to sell you. I was never held at gun point to enjoy playing the slots....or dancing and enjoying all the fun. I have visited many night clubs and been offended more than I care to remember with all the sexual comments. Why use a private IM when you can make yourself look like an idiot. Plus I have spent many a night at Extremes and seen people banned for indecent and mean behavior. Hell yes Chilly has the right to complain....if you were never there how could you possibly know what decent people the owners and hosts are and were....None of us were forced to go there and the only reason the Lindens are stopping casinos is the same reason the government legalized drinking...they weren't getting a cut and realized something good was happening when the sim kept getting blown away because of the attendance night after night....yes I will back any type of support for Chilly and anyone else that is offering fun and great memories with good people. As a very mature adult who is probably old enough to be most everyone grandmother I for one find it very offensive that anyone makes decisions about how I spent my Lindens which I choose to purchase. Now let me see...it is quite all right for someone to sell me land that I don't really own, and it's quite alright that I spend thousands of Lindens on my inventory to find out its gone the next time I log in, but as an adult someone has to protect me from the evil casino owners who are stealing my Lindens, which btw is NOT real currency. opening up a lawsuit on LL doesn't do anyone any good especially the people that are opening it up..i would sure hate to be in a court room and have all my private im's spilled out for all the world to see in rl..because you can bet that anything you ever said in sl will be looked over and used against you in a court of law..

Chilly, if you're not looking to send a message to LL, then why? I am genuinely puzzled.

If you go ahead with this, you probably will have to pay your lawyers, because the class is not big enough, nor is the entity being sued wealthy enough, to make it worth doing on spec. Unfortunately, you have a long way to go in fundraising ... $L250K is roughly $1,000 U.S., true? or less than 4 hours of a decent trial lawyer's time. So, maybe 7 hours of work on your behalf (figure that much of the legwork is done by paralegals).

Of course, you did say you wanted a GOOD lawyer. Okies, that'll run you $500/hr.

So this will cost you real money. You must know you won't recover that ... so you're not doing it for the money. You're not doing it to send LL a message. Are you trying to punish LL? If you were successful, you would end up punishing a lot of people who love SL (and some who make a living from it), because the PR hit would be immense, and SL might close. So ... why are you trying to do this?

Chilly, regardless of the merits of your case, soliciting funding for it on LL's forums is definitely gutsy but ... um ... not well thought out

There use to be a time where threads like this became locked. Laughs at those that continue to bash issues like what chilly is trying to say. The sad fact is people just dont care anymore. Awhile back people cared about each other on sl. Now its all ME ME ME ME ME ME........The older users here understands this..stabbing people inthe back is the sport on sl withthe new Second life. As the game grew so do they lower life forms of users as well.
