It's possible for them to steal your textures direct Cubey/Torrid, not screen caps but perfect copies, so don't discount it as a possibility (It's not an exploit before anyone panics but it's do-able).

I imagine really this isn't malovent, just lazyness. Whoever got tasked with converting it probably wasn't even aware of any of the contracts or agreements, they just did their job of converting the content. Even if they had suspicious they probably aren't in any position to be asking questions of the management and will just blame it on communication ("They told me to convert everything";).

If so, that's pretty interesting. If not, I'm not sure what the point is... it's a different market.

I am not sure the markt is all that different, I would say there is a lot of cross over between various games, and SL is marketed to the gamer audience. I know with NWN you could du such things, but I don't knw about DDO. I have only preordered it, I have not played it yet lol

Most 'gamers' I know are very disappointed in the 'gaming' aspect of SL. At first the freedom and flexibility have gamers thinking and drooling. Then lag, physics and other things kill their hopes. SL is like MS Works, its does alot of things but not alot of things very well.

As far as DDO, I was testing that for awhile but havent been back lately. I hope they worked on their combat system as it was a fast blurr and not exciting. It was so fast you had to scroll through your logs to see what happened. And even so fast that spell casters bitched because battles went so fast they couldnt get off alot of spell and felt uninvolved and uneffective. It will pull some people from WoW but I dont know if in the long run it can even compete. I hope it can because I was an old paper and pen D&D'er myself.

I asked the questions I felt needed to be asked for clarification and I gave an opinion. We can't all be perfect so learn a little torerance. Jake talked about legal issues NOT me.

I might not always phrase things the way ppl think I should or give the raa raa LL cheerleader responces ppl think I should. But they can seriously count on my always giving ppl an honest opinion reguardless of the bs flack like this. That I might add is all to often. And should of been stopped by LL long ago. The original comment about DDO came from Jake - it has nothing to do with the thread at hand, but it has ended up being a side discussion. There is no point related to the topic, it's just a sidebar thing.

Yes, thanks for the clarification and screenshots, Cubey. That's really a shame.

To echo Beryl's thoughts, I think this situation is a good lesson for all content creators. Unless you're willing to sign away your IP rights (via work-for-hire contract or the like) please protect yourself and your creations. I think in earlier days aggressively defending your rights was thought to be antithetical to the communal spirit of SL (it was a different world). But with the recent surge in both population and popularity and the interest of large corporate clients in extending their presence into the virtual world, the need to leverage a specialized talent pool (all of you) will only become greater.

You're talented and you've got good stuff. Get compensated appropriately and be aggressive in protecting your rights when providing content to a third party (or the first party as the case may be). Retain a lawyer if you can afford it, but if you can't, seek advice from someone experienced in contract negotiations (small business owners, freelancers of any sort: designer, musician, etc.). And be willing to walk away from a deal if you can't come to a suitable agreement. There will be more.

I was wondering about that myself and I tend to agree with you that this is beyond the scope of what's covered in the TOS. It would be nice to get an official LL position on this so that people can make intelligent choices when these kinds of offers come up in the future.

hehe, that would definitely be one possible choice. I think Bedazzle got a fair deal, but from what I'm hearing about what the other vendors were offered I'd probably have said no thanks even before any of this came to light.

Really... I wondered why Wells Fargo bothered in the first place.

SL isn't a practical platform for what they were/are trying to accomplish.

If they were able to package their own AW client, then that would be much more suitable for their purposes.

Which is a false number anyway. Users who leave Second Life entirely are not subtracted from that number, so it never shrinks, only grows.
