I think the First Amendment is behind DOMA (The Defense of Marriage Act).

How could gays win this issue? Perhaps petition to have consummation done away with altogether as part of marriage and let a marriage be simply via a license and the signing of said document. Once it's signed, no recourse for annulment, just divorce. Just a thought...?

And I don't see enforcing common law statutes on states as an option because I don't want to be married because someone says "I have too be common law married". I don't want to get married, not at this point in time. I have no desire to be married right now nor forced to be called a common law marriage. Anyhow, my state does not recognize common law marriage so you have to realize it's a big mess because each state can set their own marriage laws within reason of course.

It is not.

Regarding religion, the First Amendment does two things. It prohibits the establishment of an official state religion, and guarantees the right to the free exercise of religion.

If the DOMA is based on religious beliefs, it would be unconstitutional under the First Amendment, if anything, as it would be legislating religion.

The DOMA addresses the rights of states to recognize same sex marriages performed in other states under the full faith & credit clause of the Constitution, not the First Amendment.

As far as the First Amendment. It's winning, dude, can't deny that no matter how much you want to side step the importance of debating about this, but take it to an appropriate forum which I mentioned over a month ago!!!!!!!


Except, and I think you keep missing this, based on your posts you are on the other side of what the First Amendment really says. You assume to speak with and within some established religion and, at least de jure, they don't exist.

I would say that your holidays managed de jure status, except none of them are really yours, other than through theft. Yule predates Christianity in several forms (as would be expected for something that is or approximates the Winter Solstice), Easter you have a death but kept the bunny and egg from the fertility rites to reaffirm life for us pagans, and on and on. Hallows Eve we don't even need to go into... (Happy Samhain to you, to.)
