This is laugh riot too funny (Quote:
It seems that Bragg lost thousands of real-world dollars because the company didn't like the way he exploited a glitch in their system.)
he exploited there system and he doesnt like the fact he got kicked out lets just see what the deffenition of exploit is merriam websters has it as
: to make use of meanly or unjustly for one's own advantage i belive that violates the tos set up and agreed to by mr bragg.
I hope philip not only counters this law suit with a multi million dollar one i hope he also has him arreseted and thrown in jail for digital piracy

LMAO, you have got to be kidding me. So someone is suing LL because he got in trouble for trying to take advantage of a glitch and lost money upon trying to sell the land he scammed. That would be like me trying to return something I stole at the store and getting the poilce called on me and me suing the company because hey, when I stole the item and left the store, a security alarm never went off...

CLASSIC!

Like Tony Walsh said, I think he's doing it because nobody has done it and won. I guess he thinks that if he wins, he'll be famous, but he's not going to win, so it doesn't matter.

Hmm. "Dude, your deadbolt didn't work right, so I came in your house, and took all your stuff. Which is cool 'cos my computer totally sucked ass for playing SL. Thanks!"

Can you say "Countersuit for fraud?"

Shh. He's a lawyer. A personal injury lawyer, but still a lawyer. And he got his degree from a highly prestigious world-reknown online university.

Let's not assume he isn't an expert in the matter. Gosh knows that I wish I graduated with honors in real estate.

As a side note: I do think he is doing it to get publicity. He sent an email to new places that had his side of the story. I guess they weren't interested, and he did a story on himself.

Well maybe it's not so silly after all.

No. One thing I'm certainly -not- doing is saying he's one of those.

Yes, but you have to book him at least a year in advance so he has time to take the necessary correspondance courses. :p

Pft, no! He'd sue me if I said that. One thing I'm certainly -not- doing is saying he's one of those.

*laughs* I can't WAIT for that one to get to court! It's like a career burglar suing a homeownr for an accident in their home, while he was robbing it! Or trying to sue a manufacturer for a defect in stolen goods, and admitting to the judge that he stole them! LMAO.

This idiot intentionally tried to screw the system, got caught red-handed, and now he's going 'poor me'? Oh, that is just too rich...

This should be interesting: http://tinyurl.com/keb76

Does he even have a legal leg to stand on... The TOS says the Lindens can terminate an account for no reason at all and may give no explaination at all for termination of said account.

Sounds pretty simple to me.

Only if the coffee had been stolen ;)

He obviously didn't read the TOS.

The Judge will, within 1 minute of reading the TOS, say the case is thrown out of court.

A specialist in everything is a specialist in nothing.

It's a publicity stunt on behalf of himself. PR wire isn't worth much. Reporters look at that only when they have extra time and a hole on the page to fill. I hope he wasted much money putting his name out there.

More like worth nothing. PR Wire isn't vetted. Anyone can submit to it. Anyone who gets a story off of PR Wire usually researches it a bit to verify it, since it does operate in an "everything goes" manner.

Its a shame the bloodsport agenda is overcoming a useful discussion of a truly interesting legal case of first impression.

This case has the potential to establish interesting and important legal precedent concerning the application of consumer protection laws and commerical codes to virtual land transactions. It's almost a moot point whether the TOS was violated because the matters before the Pennsylvania Court will require the Court to determine whether the Pennsylvania Consumer Protection Laws as well as the Commercial Code extend their protection to intangible property in the metaverse. Once the Court makes that determination then it will address the merits of Bragg's case.

This determination could have far reaching meaning for us all.

It is actually a fascinating legal matter that Bragg brings before Court, one that may actually work to establish precedent that will extend way beyond the facts of this case regardless of the outcome as it relates to Bragg's transactions and the TOS.

Any person here who has a significant investment in SL will appreciate the importance of such a precedent.

As an aside note to all "swear by the TOS" advocates...here is a tip. Anyone can put any clause they want in a contract or even in the TOS for an online game and it does not mean it will stand up in court. The TOS is not untouchable legally; the real question is whether the case is worth pursuing.
