This thread sooooooo delivers! and delivers and delivers Really though my understanding of class action lawsuits (from reading a John Grisham novel) is that the lawyers bringing the suit advertise for people to join. I've seen these ads in the paper and in magazines and even on tv; they say something like "Did you buy product x from company y in December of 2007? Please call this number to see if you qualify participate in our class action lawsuit as one of the plaintiffs." I don't think the group usually forms first and then seeks legal advise. _____________________

Yes, true. I think the intention of forming the group first is to get some very much needed cash to present to a lawyer. Even though it has been said a few times here that if there was merit for a case a lawyer willing to take it would do it pro bono.

OK ok ok.... this is just crazy, i just got here and I have talked to several ppl who own businesses and Land who have gotten ripped off by other Second Life residents, so why the hell do you think I or n e one else with common sense would give you any MONEY for a "Good Lawyer". Good Lawyers do not exist, what plant r u smoking? You seen that man shoot at that lawyer in front of that court house on national tv, and you think imma break my back to give someone who deserves to be shot my money? You are huffing a heavy one lady. Instead, i will do some advertisement outside of SL and bring more ppl here. Not try to run them out. Of course LL has their good and their bad, but they are putting all of this up for you, so YOU, I and everyone else can have some sort of business opportunity. Depending on what you know, will let you know how far you can go. So, please do not come here trying to make your opinion everyones. It sounds like you have an excuse for ppl to give you lindens... and who owns the group? Let me guess... You chilly, right? **goes in-world to check**

Chilly appears to be focusing on an exit strategy - and maximizing his return when he cashes out. But if he waited even a year from now, the cost would be less thanks to the developments like OpenSim and Central Grid. It's the dreaded competition pushing prices down. It is something that *has* to happen in time. Getting huffy over it is a pointless exercise unless you fell just outside the grace period. Your overall expenditures for an island over the course of two years is not significantly different, thanks to tier.
Chilly should focus on maximizing the use of the islands rather than cashing out if the islands are profitable. If they aren't, then yes, that's a business decision that needs to be made. _____________________

Those ads do not go out until the law firm has been retained by at least one class plaintiff already. It's a violation of the code of ethics for any law firm to do otherwise. Ah. But I think there are firms which specialize in class action suits? (according to John Grisham). I was under the impression that they make their money by getting big cuts of big settlements not by charging the person who initially hires them. I guess OP wants to raise enough money to buy a consultation with an expert. _____________________

I still think it would have been more fair to calculate how much money the reduced server parts would have saved them and instead of lowering SIM prices by 695$ give some sort of discount to everyone tier fees. Or maybe a combination - Enough to stimulate the land and Sim buying market - without heavily undercutting resale value. ----------------------- But LL must have a marketing department of MBAs who decided it was better to do it as they did long term. I doubt they are thinking so much about current island owners as they are "the larger number of Island owners in the future" (tm) I think LL still thinks (and maybe they are right) there is a lot of room to grow still and 200,000 concurrent users are right around the corner .. In which case they will need a lot more landlords than they have now. ------------------------ Colette....interesting points but if you look at it from LL's stance, they are positioning. And in positioning what is more attractive to say an 'investment community' ? Profit up front? Or developing a nice RMR stream (recurring monthly revenue) Slashing the prices upfront allows people to get in who wouldn't consider it before. And, that brings in more monthly fees.....which is the big attraction. Now of course SIM owners are going to complain that they've lost. Some will, some will break even, some will profit. Before this even came up, Islands were 1675.00 each and there were islands that were still selling for 4000USD. Hopefully with a steady stream of new cash coming in per month, perhaps that can be put into hiring more wiz kids that can help bring SL to a stable platform. There's, uh, probably a lot of things you didn't know about lindens. Another, another interesting, uh, lindenism, uh, there are only three jobs available to a linden. The first is making shoes at night while, you know, while the old cobbler sleeps.You can bake cookies in a tree. But the third job, some call it, uh, "the show" or "the big dance," it's the profession that every linden aspires to.

Doesn't sound to me like Chilly expects to use the "they banned gambling" argument. Sounds to me that the the land thing is the chief issue at this point. LL falsely advertises about "ownership." They pitch an economy run and owned by residents. They claim to have a community standard--which is not enforced worth a darn. In one breath the Linden is fictional and cannot be exchanged then says it can be exchanged. Its all tranparent double talk. They say they own every Linden$ in the game. The "assets" the avatars, all of it....is owned by them----yet they advertise otherwise. It was LL that was allowing the illegal gambling. How much money did they make with all those casinos...while they were flying under the radar? It is LL that allows the land scams. It is LL denying responsibility. They want it both ways, while advertising a third way. If it was all just fictional and had no heavy monetary impact on others, then so what if they change the Linden price of a sim? Then it wouldn't matter. But we are talking about REAL money. I think the sims should be included in the Premium accounts and for minimal fees, and all sims should be on people local computers, but to transtion to that, which IS inevitable, LL can't just crap on existing land owners who spent REAL money, after believing their advertising. They want to kill their most loyal residents? Very bad business, but also creepy and crooked. Regardless of the excuses or avoidance, LL has been complicit with the gambling and the Ginko/banking /ponzi scams and are complicit with the land scams, just by virtue of the fact that they only give lip service about enforcing anything, but still benefit from the crooks and cheats, payments. LL has not a leg to stand on. Their TOS is unconscionable and has already been found to be such in court. Either their ethics are unconscionable or their haphazard behavior is bumbling---either way they are responsible. They are breaking all kinds of laws and codes and rules. They have been inadvertently or dumbly (you can decide) violating all kinds of banking, security and investment laws. They can "print" Lindens out of thin air, yet did not reimburse people who have been scammed--due to their flakey systems and enforcement, by simply printing Lindens. With sim owners, who have had a reasonable expectation of being able to sell their sims if they have to, LL has now altered that drastically, without making ANY provisions for those existing sim owners who are overnight finding their sims value is cut drastically. They could at least lower tier for those people until the difference is made up---anything to demonstrate good faith. LL cannot legally offer investments, but they do. The whole thing has been based on that. The fundamental mistake was the way they designed the world using their servers. rather then sticking to what they say in their sales pitch about "ownership," and pretend they are just a service provider---as though they are merely a Web host changing the price of their services. Give me a break. Some smart attorney could make a bundle off this one, if he could find enough people who have broken free of the effects of the kool-aid. |
