In context, it was in response to my pointing out that, should backups fail, he's SoL and being SoL we can thank the new ToS for... the last comment may or may not have been directed at me. I merely pointed out that, if it were directed at me, not to worry, as hate predicates a willingness to vest effort and he had not demonstrated anything that would mean he was worth the effort.

As for mean and rude, let's just say he gives as good as he gets and leave it at that.

Yep, if backups fail we have no recourse or compensation. How would they restore our stuff? Magic? Anyone who believes that if such a catastrophic event happened we'd be given recompense is naive. This is not new. It has been this way since day one. I really don't have a problem with it. It's the nature of the beast. I'm not sure why you're so bent out of shape over a clause that LL would be insanely foolish not to have in the TOS.

Yes, Chip, I know, *edited* because heaven forfend a company should ever be responsible to YOU for losing or destroying things.

But for folks like me, the concept of equality in a contractual agreement are not alien. When I pay for something, I expect to have it and those who hold it for me are expected to take proper steps to insure its safety.

If they fail to do so and something happens to it, I expect them to either replace it exactly or, if they cannot, to compensate me for fair market value of the item.

In this case, 'fair market value' would be either the $L cost of the item or the $USD cost of the item OR a reasonable approximation of lost $L revenue for the item.

I fully understand you don't mind being fucked over. I do.

Then I guess you must not participate in any MMOG's at all since they're all the same way. If WoW has a server glitch and loses your +20 sword of ubersmacking do you think you're going to be compensated for it? But carry on having your hissy fits that the world doesn't work the way you think it should, because it never has, and never will. Everyone needs a hobby I guess.

Big difference. WoW says the sword doesn't belong to you. LL says your content is your property.

Look, I can't help that you don't see or understand the difference, but that doesn't mean it doesn't exist. So, to turn your phrase back to you, go on and have a hissy fit because you don't understand how the world works. Your hobby of pretending to knowledge while demonstrating profound ignorance does have some amusement quality.

P.S.: Thanks also for acknowledging that with the new ToS, LL is basically nothing more than a game... albeit it with piss-poor performance, little to no data security, counter-intuitive toolsets, and underwhelming service.

No, Ricky. You own the IP rights, not the digital assets themselves. There's a huge difference. LL doesn't own the game Tringo. Kermitt does. But Kermitt does not own the assets related to Tringo that exist in SL. If LL started to market a Tringo game, Kermitt would have grounds for compensation. If SL blows up and all the Tringo boards and scripts go poof, he is not entitled to any compensation.
