From: Shorti Ferraris Wow i feel like i open pandoras box here. Well the thing is when i moved in the stuff thats in the covenant now was not there. Only how to pay the teir box and how much you pay. There was nothing about leaving penalty and all this crap. Also at the time I was a newbie. And to answer one of the threads it must be 10 days notice. Not everyone knows 10 days in advance they are going to leave. I had no idea they updated the covenant until I decided to leave. Also if he was a really nice person he would have notified people of a change in contract. Ok also its not just 2500 its 2500 x4 (4 lots) then wants 1 months teir fee (4000) on each to leave just because i didnt tell him 10 days in advance thats a lot to pay there. Out of curiosity.. How big were these lots that were costing 4,000 a month tier, and how much did you have to pay up front to "purchase" each one?

A covenant isn't a contract, it's an agreement that neither party has to actually adhere to. If the sim owner doesn't like you, you get kicked out, if you don't like it, you leave with no further responsability.
I'd actually suggest against notifying. It wouldn't be the first time that a renter ends up estate banned and told to pay extortion money to be allowed to come pick everything back up.
(Based on the "threat" of what would supposidly happen when you don't notify. If you know the sim owner is nice and will hold out waiting for a week past-due then it's an entirely different situation)

The landlord is smoking crack to expect payment of a departure fee AND an additional month of tier. Also, unless my math is wrong, there are still 14 days left in July, so how can he say you haven't given the ten days notice?

I have been trying to leave for a month and before when i said i wanted to leave he would get smart with me saying hey lady you better pay and at this point i thought i would get in trouble with lindens so i told him i try to get the money so then get got nice. then i asked around and people said he cant make you pay all that so i decided to just leave it then he come back to me with threats of banning from sl if I dont pay. so he likes to threaten if your not going to pay all that money. he will get nice if you tell him you try. but just keeps being nasty. i am not willing to pay all that money if it was added later and never told me. basically he threatens me to stay so he can have my money.

Sounds like a great landlord. Don't know why you've put up with the threats for this long. Time to collect your prims and find a new place to set up house. You might also want to preemptively add your soon-to-be former landlord to your mute list to avoid receiving any more threatening IMs.

If you have been trying to leave for a month that is above and beyond the 10 day notice. A good landlord isnt known for these kind of actions, but for how good they treat their tenants. Changing a cov is, in my eyes, a sneaky way of changing the 'rules' on someone in order to hold it over their head and is complete BS. Period. Oh sure, the landlord can kick someone out for no reason at all, but they dont want people to be able to move on for the same? I'm actually glad that LL wont get involved in this sort of things, people need to take time to write out a clear and correct Cov for what they want BEFORE someone rents the land...not after. Trying to leave for a month...seriously...log in, gather your junk and wave buhbye now before this bully tries to pull more lindens out of you.

From: Nina Stepford oh ffs! spare a thought for the estate owner! he's got bills to pay and he's trying to get you to do the right thing and give him notice you are leaving. how hard is it for you just to tell him youve changed course, then he can have a reasonable amount of time to line up another buyer. just had to reply to this... i have my own island i have my own residents if a resident doesn`t pay on tier date, i ask him/her what`s up to see if it`s an issue and they need a couple more days to get the funds if they say they want to mve out and don`t pay tier, i reclaim the land reclaimed land = landlord "bonus" as the land can be resold again reclaimed land > month fee ppl want to forfit(sp) their land with not paying tier? up to them as they know the consiquences sending them another bill after making a net profit on the land resell is STUPID and ignorable only have 4 tenants but damned if i`d treat them this way ffs

Utter crap. If it was, indeed, not in the covenant you agreed to when you initially purchased the land, it isn't remotely binding. Threats of being banned from SL are simply that - threats - with no real basis in anything.
Of course, if he's dishonest enough to change the covenant after you agreed to it, then insist you adhere to the changes, he may be dishonest enough to fake an accusation serious enough for LL to take notice.
But somehow I doubt it. I'd leave and count my blessings that I got away.

i thought it was important for people to acknowledge that there was another side to the story. theres no point in trying to split hairs and debate legalities. we dont know what the landlord actually said to the op.
'what if i dont pay?' 'well, i can only ban you from our sims.' 'you cant ban me from sl!'
for all i know that was the conversation.

You are right that there are absolutely two sides of the story. We can only respond to the side we know - what is the point of making up a side we know nothing about?

Unless the covenant originally included language precluding prior notification the landlord had an obligation to let the tenants know that there was a covenant change being made. _IF_ there was no language in the covenent precluding prior notification at the time of purchase (whether you read the covenant or not [and you'd still be bound to it anyway]) you were given no opportunity to decline the covenant change and move. Short form: You're off the hook.

From: Shorti Ferraris I need to know if you owned land from an estate and in the convent (but didnt see it) says you have to notfy before leaving and you dont you must pay 2500 fee plus a whole month of teir is this legal? or allowed and if you dont pay can you be banned from SL? You can crash the grid over and over, and they'll maybe ban that named avatar. But you can be back in world- openly, and publicly with a fresh new one, with no consequences. So I would guess no, you can't be banned from SL.

Just LEAVE for pete's sake! Have you looked at the world map recently? THOUSANDS upon THOUSANDS of islands and mainland areas. OOOOHHHH he's going to ban you from his estates and tell his friends! That's like what? .002% of land that you are banned from? Maybe look down as you walk by that little pebble on the sidewalk so that you don't step on it. He's threatening to get you banned from SL? I wonder how he's going to do that? Maybe he'll hire that assassin guy that posted on this forum a month ago. I'm not saying to become a total douche and not read or comply with any estate covenants but to deliberate this long on something so inconsequential is a bit crazy.

Cant believe this thread is still alive...the bigger thought in my head is "Have you left YET?!" trust me, there are plenty of places to rent from that are not so unresonable in their cov and terms. Move move move!
