An apt comparison, Chris.

The Adult Content clusterf*ck is his latest pogrom. By indirection, miscommunication, silence, spin, and outright lies, LL is planning to squeeze adult content out of Second Life, or at best marginalize it.


Lindal ~ This is exactly why I started this thread and based it Kingdon's own words. I sincerely wish that people would take the time to read his articles and realize that the SL blueprint has been there all along.

He will not have adult content disappear altogether so your use of the word marginalized is aprapo to what will happen.

In Disneyland, is there adult content of any kind? You can go anywhere and always be assured that the content is rated G.

Desmond mentioned that premium accounts are the new adult accounts. I don't think so because the upcoming restrictions will be such that in-world adult content will only be available if you pay for access to it in-world. Kingdon has stated as much that it will be like the web, you can browse anywhere, but if you want to see dirty stuff you'll need to pay [That is not accurate, but it is how Kingdon sees it. Premium accounts will have different benefits - not including adult content. Access to marginalized content will not be made easy.

Kingdon also has an article on searches that ties into his view of adult content.

Again, I repeat, if you want the blueprint for SL's future, study his past.

P.S. There are no substantive grounds for a lawsuit on this matter. Disneyland is coming, and what is important now is how you prepare for it's arrival.

Correct, and sometimes it does pay off, but if McDonald's had a TOS signed by each customer the outcome would have been different.

Maybe these guidelines will help prepare for the arrival of G rated SL:

Be sure to have a traditional family: Husband, wife, 2.5 kids, cat or dog, house in the suburbs governed by covenant, and a vehicle that gets about 10mpg.

If any adult activities occur within said house, they must occur behind locked doors with no peep holes, and under covers; access to the web and TV have parental controls engaged allowing only G content. Obtain banned word list from LL and enter that in the blocked sites feature.

Children are home schooled, or if that is not possible they attend faith based private schools.

Libraries have only content approved by Focus on the Family.

Sunday's, or day mandated by your religion, are spent in church, as well as one evening per week. Other evenings, and weekend days, are spent in as many activities as possible. Idle hands are the devils workshop!

Never, ever, drive near "red light" districts so children won't ask embarassing questions.

How to prepare for G rated SL?

Really, your question is a good one. Is it far fetched to think that Ursula will be accessible only by clients who buy a pass into it? LL can double dip: One by charging tiers; secondly by "adult pass" sales.

I don't believe that LL gives a rip about age or any other type of verification. All this appears to be is a prelude, a dry run, to manage and charge for access to adult content - which is what Kingdon described in his articles.

The legal theories are fraudulent inducement, straight fraud, and breach of contract.

Linden Lab induces one to spend money and invest in Second Life based on a particular set of rules. Then Linden Lab changes those rules unilaterally to the deteriment of those it induced to spend.

It is not the creating of virtual Disneyland that is illegal. What is illegal is the bait-and-switch on the adult content creators who are being damaged.

Linden Lab could avoid legal liability if it can somehow effectuate the change without causing any loss to those currently doing business within Second Life. Linden Lab could also stave off lawsuits by simply compensating users for the damages caused to them.

Linden Lab has every right to do whatever it can legally to make its product more profitable. It does not have the right to force those costs onto you without consent.

It's like any other bait-and-switch. It's like any other contract case. I hope that no residents lose money on these changes that Linden Lab is making. I doubt that, so my next best hope is that when Linden Lab does it, the damaged residents finally sue Linden Lab into oblivion.

And their intention was to defraud? Are you sure about that? A breach of contract is but a trifle matter like making a late payment on a credit card. LL will always maintain that the agreed to TOS is the contract. And unless you are willing to spend BIG bucks for the long haul to prove intent, a lawsuit will go no where beyound it being filed.

Question: Did the class action over the open sim fiasco ever get filed? If any one had grounds for a suit, that would have been it.

Understand, Amity, I am not a Linden, am very unhappy with the direction that Chairman Kingdon is taking, and really am not opposing your point of view. But people often wave the threat of court action, but it is a vaporsuit [like vaporware?], when there is perceived loss.

My attempt in this thread is to show that Kingdon has a plan for SL, and has had it since before he was hired. People can speculate all they want about what will happen, but the truth is in black and white for all to read.

It is much easier for most people to stick their heads in the sand and ignore the inevitable and whine and complain and cry when theory is put into practice.

Will a lawsuit change his mind? Nope. Complaining and threats of court action mean nothing to Chairman Kingdon.

Now just imagine a big white castle on mainland, down main street you see Micky and Minnie swinging in step to the beat of a G rated world, and everyone is smiling. There ya go. Now don't you feel better?

Fraud can also be through negligence or omission. Finding the smoking gun of a scheme to defraud is the best case, but not the only one. The scheme does not necessarily be from the outset; the scheme could also be developed on the lines of, "Hey, we have all these people invested already, let's see what we can squeeze out of them."

Plus, Linden Lab sure does act like a company with a lot to hide. When filing a lawsuit, you need to be prepared to go the long haul. But my instinct is that they aren't willing to go through discovery, turning over documentation of whether they are evil schemers or incompetent idiots, and either way they will fight until they have to turn over documents, then start making settlement offers (which is how it happened with Bragg, if I recall correctly).

Unfortunately, you have one realistic point. Justice isn't free. Linden Lab can get away with screwing over a lot of people, as long as they don't screw over any one person for too much at one time. It's a shame. But either they will screw over someone for too much, or just make someone mad enough from getting repeatedly shafted, that someone will finally take action.

You are also right that threatening lawsuits won't change anything. Someone has to actually pull the trigger. Linden Lab is used to the resident base rolling over to them; they aren't going to believe otherwise until they see it.

But what I don't want to see is the mentality that Linden Lab can act with impunity of the law. That's what they bank on to protect themselves from legal action- the collective belief that the residents are powerless to enforce their legal rights against them, or that they have no legal rights.

At this point, with this issue, probably about all you can do is document everything about your SL dealings, so you can prove what they have promised, what SL was like when you started dealing, and what you lost when they made the change. Be ready with everything in hand when you do have to file the lawsuit.

Maybe you can head them off in the media. The media isn't going to listen favorably to a complaint that Linden Lab is driving off adult content. What the media may listen to, and what Linden Lab would actually fear, is stories about what a rotten, negligent, untrustworthy, deceitful company is when it comes to the way they conduct business.

As far as actual legal action, I'm not sure there is much to do until Linden Lab finalizes and implements it policy. Anticipatory breach of contract is a possibility to go in early, but the chances of success may not be great. Unfortunately, to get help from the courts, usually you have to wait until after you are damaged.

But yes, lay the groundwork now for what you may do in the future. If you aren't building your legal case now, you may not have the ammunition to go through with it when the time comes. Don't be afraid of them because they are a company. Don't assume because they are big, they can do whatever they want. Juries hate companies that screw over customers. Actually, judges hate dishonest companies too. Courts protect honest business dealings, not dishonest ones.

I think Chairman Kingdon is counting on the majority of the population to swarm to SL after implementation of his vision. See, about 75% of the US population believes in the good Book. Sex is bad, except for reproduction. The earth was created, by gawd, 6k years ago, and humans walked with dinosaurs.

You ask, what about non-americans? Eh? So what? If they really, really want the SL experience, they'll adapt to the american G-rated experience.

Funny, it is was the German and UK mainstream presses jumping on the "OHNOES SEXIES ON THE INTERWEBZ" band wagon. And if you listen to some of the spokesweasels for LL, it is the "enlightened" educators who were clamoring for the coming changes. But don't let the facts get in the way of your biases.
