If account sales are against TOS, why are they permitted?

I know there was recently some discussion about this, but I lost track of the thread and cannot find it now. Based upon this portion of the TOS: From: The Terms of Service 3.5 Unique Accounts; No Transfer. When an account is created the address on the account must match the address or other unique identifier on the credit card or other payment or identification method. You may register multiple accounts per credit card or other payment method but will only receive one trial period for the card or other payment method in any 3-month period and each additional account on one credit card or payment method will begin its billing when the account is created. You may not transfer your Account to any third party without the prior written consent of Linden.
If this is in fact against the TOS, and Linden Lab is not providing written consent to do so, why is it being permitted? The account of a relatively well known clothing and pose designer has been sold to another player, who is actively using the account and continuing to sell under that account name. The same player is also openly soliciting in group IMs for anyone who wants to sell their accounts and rights to their creations. This has been reported repeatedly to LL, but nothing has been done about it. If account sales are perfectly fine, then why have contradictory TOS rules, and if they are not fine, why is it not being enforced? Note that the TOS prevents me from naming names, so those who are aware who I am talking about, please keep their name out of this thread - I don't want it to get locked in a flame war.

I dont think LL really gives CONSENT like we think they do... perhaps MAYBE if there was a death and the SL account was left in a will of some sort... BUT when Asri Falcone got her account hacked, the hacker sent emails to LL requesting permission of the "sale" of the account, after speaking with LL on the phone they clearly stated that the email meant nothing because they DO NOT allow account sales.

Yeah I have noticed that myself - I find I have often had better luck with general posts than hotline - many will go unanswered, especially if they are remotely controversial. I would like to see an "easy transfer" tool... the account and everything on it would transferred to a new owner... and then it would be renamed. This would allow us to sell accounts and "cash out" while also getting around the reputation problem.

Perhaps they haven't received an abuse report for TOS violation yet. What if you could just do a "Transfer all assets" and it would sell everything, all your land and linden balance and inventory, etc.

I downloaded the client tonight to read the TOS that comes with the software. Evidently on September 9, 2005, a change was made to the TOS to reflect this: 3) Explicitly prohibit transfers of accounts without consent of Linden Lab (Section 3.5). Guess account transfers are like sex -- it has to be of mutual consent with the Linden's or else it's a crime. So the questions are... Was it (the sale of the prominent account(s)) brought to the attention of the Linden's and did they approve of this transfer/sale of account(s)? Did this transfer of accounts occur before September 9, 2005 and the updated TOS? Or are Mommy and Daddy Linden not watching what's going on within the SL boardroom/bedrooms with their content creators? It's interesting to see the soliciation of purchasing accounts from a known member of the SL community -- even though they know it's against the TOS to purchase the account. Maybe it's just the way the solicitation is written. Then again, it could be my comprehension skills. Maybe they were offering sex to tourists.

sorry but nothings gonna get done, cause this person that did it , pays thousands to LL per month to be in SL. Now y'all understand? they won't take no action, why they wanna lose that much money per month??

LOL omg Lynn I have missed your posts  your so very right! They turn a blind eye when it suits them. I tend to take the "lets get real" approach myself. Do they really have the manpower to make sure everyone is following ALL the rules both new and old? Oh hell no. Lindens are a funny lot, I will give them that.
