From: Snickers Snook And, you may not know this but actual clothing designs are NOT copyrightable under US law. That's why direct copies of hot designer dresses (ie post-Oscars) can be made & sold literally within days of being displayed. Lots of designers on SL photosource details like belt buckles, zippers, buttons, etc. I've done it on some things although i usually end up redoing them by hand. As with most things legal, the answer is "it depends". BTW, I am very careful about my virtual fabrics. Most of them I've made myself using photoshop patterns but some have come from creative commons. I did photograph a 60's dress I bought at a thrift store because I loved the fabric. It's used in one of my outfits. So will people slap me for not being a purist?? I wonder how many designers do this?? I'll say this though, if it gets too complicated or puritanical to make things in SL, I'll just fold my shop. There's really no money in what I do so to hell with it. If you photosource any other pictures than you own, you potentially violate the copyright of the photographer or whoever owns the copyright of the photo, not the actual subject of the picture (depending on the subject, there could be some implication there too). So let's say you photosourced Jennifer Aniston's dress from some award show. You'd be potentially infringing upon the copyright of, say, Getty Media.

From: Amity Slade This is one of the things that always frustrates me about Second Life. Some very basic functions seem outwardly so simple to use, but have hidden features/bugs waiting to trap the inexperienced. I thought it was common knowledge really. You can wrap a copy item inside a transfer giftbox that someone can buy, as long as they don't rez the giftbox, they can give it away and the recipient ends up receiving a copy item. That's a very useful thing to be able to do and they are used in practice. (Removed the other example cause I'm having trouble recreating it now )

Someone suggested previously requiring that one can only become a SL merchant if certified after some series of classes.
It was suggested as a way to protect consumers.
However, I think it would be a good idea to protect the potential merchants who come to Second Life.
Yes, some of those are the newbies with L$ in their eyes after promises of "Your World. Your Imagination," "make money- yes, real money." The ones who sometimes come to these forums on their rezdays to say, "Show me the money!"
There also those who a fairly smart, cautious, studious, and still get slammed by the inobvious technicality that ruins a lot of hard work.
And then the smart, studious ones who are so cautious that they are scared to death to engage in SL business because they know there is the inobvious technicality out there waiting to bite them hard.

From: Kitty Barnett I illustrated it for you in-world, but just for everyone else's benefit . ... Rez it, or take it from the prim's inventory into your own and rez it, change permissions on it, take it into inventory (and optionally put it back inside the prim it came from). Wow, Kitty -- thanks big time for the explanation!

From: Snickers Snook So what happens with things like clothing?? If I change the perms in my inventory and then drop them into a prim box then sell that item, are the perms as I would expect them?? Like most of my things are now mod / copy / no xfer. But I make that change in my inventory then put them into a prim for resale. Will the buyer see them that way? My head hurts. Keep in mind that we're talking about perms for the contents of an object. Clothing that never appears in the content of an object won't have the same behavior.

Yes you are right. I meant sometimes I photosource my own personal clothes. I'll scan a zipper or take a digicam picture of a detail and use that in an outfit. I've never taken a photo of an outfit from de internets and copied it.

Does anyone know if SexGen stuff sold / packaged by Briggi Bard is authentic? I'm presuming she has a licencing deal with SexGen. A friend just asked me. Despite my involvement in this thread, I actually don't spend much time shopping for sex beds :}

Yeah, I think BB was originally a partner or at least a contractor for Stroker. Back in the day, I recall seeing her name on most stuff related to Sexgen.

dismay
06-18-2008 20:52
For hours now i've read this thread and now stick up my head in dismay......
Where is the fun??? what happened to this wonderful experience called Second Life? Where is drawing a line under the past and moving on in a better way knowing what we now know and doing things differently? Catch the pantomime baddie hang him high............. If he/she copied non copiable items or release items full perms that shouldn't be where is the lynch mob for the means to that end? Why do LL allow renaming of items? Why do LL allow the unlinking of items and relinking so as to remove the originator? etc etc
Second Life would be nothing if av's can't move...yes animations must be hellish to create but sometimes as an artist (and i know) you realise you never get the true financial return for your efforts...people just can't always afford the end blood sweat and tears price so ultimately you create for the joy you know you can bring and the satisfaction of a good reputation. If you create purely for bottom line financial gain then don't do it in an arena where your efforts are not secure.
Many newbies think sex gen is a second life generic term for furniture creating sexual poses. Newcomers who don't spend hours in blog or forums wouldn't dream that 'full perms' didn't mean that or could really be stolen. We come we buy Evas bed or a more expensive fp package in good faith oblivious to the darkness gnawing away at the 'fun game'. We even get a free full perm Red marble hot tub via exchangomatic purchased via SLEX.
We start creating using the good old mlp and calling our prims what we will maybe even incorporating Evas pillow ...we realise you can transfer the scripts and animations into anything then poof the sky falls.
Not everyone trying to make interesting content is out to make a $ killing, many realise that the bulk of SL players cant afford the top name brands but would like to enhance their SL experience similarly we would never knowingly devalue the efforts of the original content by selling for L$99 whatever.
Whatever happened here should of resulted in the source member being cautioned and removed as long as the ability to rejoin is removed....er doh impossible.
Pirated content should be grandfathered in as content to make SL the fantastic place it is...a 'gift' from the scriptors. FUTURE content should be nailed down with licences and permissions set in stone so this doesn't happen AGAIN.
The biggest lesson is it isn't a game, it isn't fun it has become big business. For those that remember the night of melting casinos...of zapped banking...well sex had to be next...unfortunately it will be the smaller, poorer content creators/modifiers who bring affordable variety that may decide enough is enough.

From: Storyof Oh The biggest lesson is it isn't a game, it isn't fun it has become big business. Perhaps more accurately, one might say it's become small business. A whole lot of small businesses. Last I heard, honest small business people were generally considered a nice, desirable, useful thing to have in one's community. And Lord knows, small biz owners have a tough enough time of it as it is, without being robbed :} And yes, small biz is fun! They don't all do it for the money. And after taxes, and taxes upon taxes in RL, gawd knows there aint' much of that left anyway!

From: Storyof Oh it isn't fun it has become big business. Not true for me. I do this for fun, and I find it fun. Lots of fun things have occasional hassles. Certainly all my RL hobbies do, like playing music, windsurfing, sailing, snorkeling, scuba. Oh, reading ... not too big a hassle there. If you want less stressful leisure time, just turn on the tube or pick up a stack of good books.

Something that I think has not been mentioned in all of this is what the overall effect of this widespread copying has had on the "stolen" animations.. Now this package of animations has been used in thousands of very low cost beds, and otherwise used in many, many products.. To the point where most of those animations have little value any more.. I will most likely license a few of the animations I really like, but for the most part I will not bother with the rest as I will not be using them.. They are too common now, and anything I would try to sell containing that set would have little value.. People have seen them, used them, and would expect something different if they are going to pay high dollar for the item.. So I all I could do would be to pay a small fortune to license the animations, and then still have to sell the items at rock bottom prices, as people are used to getting items containing those animations for no more than 200L. I am right now thankful I did not actually sell anything containing these animations for if I had I would have been compelled by my own principles to legally license those animations. It would cost me much more than any profit I would have made. I really feel bad for the creators of these animations.. This widespread distribution of them as "freebies" have devalued their very hard work.. And there is really no way to restore the value again.. Even if all the "stolen" animations were deleted today, and the creators could then re-license those animations, they have lost most all of their value now.. And this is honestly a terrible thing to have happened.. I blame LL for this. They allowed the problem to just go on and on.. Doing nothing until forced to do so, and what they did was far too late, and totally ineffective.
I am not sure I am explaining myself well here. But those animations have now acquired the label of “freebie” and as such and not considered to be valuable any longer.. And any product containing them will be expected to be bargain priced.. That is just so sad, and so wrong. It hurts the creators and in a way everyone that tries to do business in an honest manner. The thieves took the money and ran, the creators lose, the customer loses, and those being honest lose.. I do so hate to see the bad guys win, but that is what has happened here.

Ah yes, good point. We really do need an enhanced permission system. Next owner, and next next owner, like some people are saying. Won't help the stuff out there, and no doubt someone will try to think of a way to hack it, etc, but still would help somewhat perhaps. This is how it all starts.. http://slexchange.com/modules.php?name=Marketplace&file=item&ItemID=669918Content is ripped and repackaged and dumped in a BIB. Many times the Reseller doesnt even know that there is stolen content in the BIB. Someone passes it to them and says "Hey..here's a way to make money..sell this" I have sincere doubts that this BIB contains genuine SexGen scripts. (Note they are highlighted).

From: Viktoria Dovgal Yes, so is Corsi Mousehold's. There are a multitude of SexGen Afilliates and Resellers Chaz. You can be assured that it is a GENUINE SexGen if it has myself or Briggi Bard as creator. Indeed, Corsi Mousehold is an afilliate as well as a contributor of animations on the Diamond series. I have yet to see any of our animations make it to a BIB. I'm sure it is a matter of time.

I am kind of surprised the animations are such a major issue.
The scripts and the concept of "sexgen" as a generic term seem to be more troublesome.
If someone were just out to steal animations, there would be more impressive ones to steal out there.
Although I suppose getting 50 at once is cheaper for would-be thieves.

At least for now, it would take somebody effort to capture SL animations and get them back up to the system, just because canned software to do that isn't really out there for anyone to download and run. Assets that have leaked out with the wrong permissions don't take much effort at all to use, and that's a better fit with the BIAB scams.

Although I suppose getting 50 at once is cheaper for would-be thieves. The scripts are GPL-licensed, so they're not troublesome. There was no IP violation on that score. Your products might seem unimpressive to someone, but if anyone could get nearly all of them for free, that would certainly undercut your business, and nobody has the right to say your products should be free simply due to the quality level. BTW, I'm convinced there's more than one version floating around, because the one I found (several times) has animations that I would call quality animations, including those from Bits & Bobs and DarkSide. Perhaps you're looking at another version that really does have some awful animations in it -- but that's still not a valid reason to undermine the creators' IP rights.

fyi for those who raised in this thread the topic of intergrid permissions (what happens to SL permissions when Second Life and OpenSim, etc, can connect...). Intergrid permissions presentation at Zero Linden's tomorrow, Tuesday 1 July 2008. /13/d5/267473/1.html

From: Johnnie Carling Ok the key word here is "Eva Capalini"
Quite a bit of the MLP scripts inworld have her as a creator (she runs a full perm shop) in fact if you have the MLP2 scripts that Cole Lear updated, they too show Eva Capalini as the creator.
Now what i think happened is someone was selling a MLP object as a Sexgen, LL looked at the creator field on the scripts then zapped all the MLP scripts with her listed as the creator.
This really seems to be a gross overreaction on LL's part. Can you imagine what the people who have sold a ton of MLP stuff that happened to be uploaded by this person now have to do to keep their customers happy.... all because one person violated trademarks using some open source scripts? Sadly... yes, I can imagine... because it happened to me. I was hoping that maybe it was just my beds in my store that all of the scripts and notecards disappeared, but I got a TON of IMs from my customers saying it happened to their copy of the beds as well. Some of them I had forgotten to take copies of, so I had to readjust everything. And then, I had to search each customer to make sure they did in fact buy the bed from me, then replace the beds for each person that came to me with the problem.

Well, if that happens to me I was very happy, back in January a6th, I bought my bed for L$999 (ID#698582124), so now that I loose the sexgen device I contacted the seller (which BTW have an huge classified) he's answer was that he didn't had that model anymore and that I could buy another (the cheaper one was 2k) and he discount 1k...
So now I'm just searching a cheaper alternative... I just bought that bed for its design and low prim... I don't want anything higher prim... crap...
