Well the way the system works now the judiciary branch of government is there to stop the voters from willy nilly making the constitution irrelevant. I tend to think one of the biggest advantages to this is that it makes it harder for politicians to trade on fear and ignorance by scapegoating some minority group of the population.

Or forcing through a fringe minority or their pet special interest on the majority?

Personally, I'm one who feels the judiciary hss been overreaching it's authority in recent years in shaping the law as opposed to just carrying it out anyway. Too much adjudicating from the bench for my taste.

Care should be taken to ensure issues aren't put to vote capriciously, but once they are put to public referendum, the results should stand as voted. We can't be looking to overturn an election just because we don't like the outcome. One need just look at the idiocy in the Al Franken/Norm Coleman race in Minnesota. The election keeps getting bated back and forth like a shuttlecock, every time a decision is made, the loser rechallenges.

Yay I've returned after Memorial Day.

The "Bay City" project thing is going good.

Watch for updates on my blog... and continue the SL patterns in the future and beyond.

edit: good take to the above poster

I hope that if the special interest group is people with African ancestry who want to vote *nothing* will protect the the the opposing desires of a majority of white bigots, no matter how average they may be.

If the special interest group is tobacco companies who want to make obscene profits from mass misery then I hope someone will realize that actually harming others for money isn't one of the basic rights upon which our country was founded.

That has nothing to do with what I am talking about. The courts have little checks and balances and it is needed for them as much as the legislative and executive branches. When they fail in the eyes of the people, then there is no choice but to decide their own future.

And I voted against the same proposition that was passed here in Arizona. But it was primarily due to having an aversion to changing the constitution.

@ Eli: Wowsers, way to go with the quick snap! Did you talk to him, or just stand bashfully next to him? :p

@ Maureen: Yum, thanks! There's this place on the road to Mt Rainier called Copper Creek restaurant, and they make AMAZING blackberry pie. Like, oh. my. god. blackberry pie. :)

I think I agree with you if you're saying that the supreme court shouldn't have the power to make unconstitutional things legal... I'm sorry if I'm not understanding you properly. I think it's only the legislative branch that has the power to change the constitution... And if the electorate don't like it they can elect new representatives to change it back I guess.

edited to add: But our real problem out here is that a majority of voters evidently think gay people shouldn't have equal rights with everyone else. The court ruling was predictable. I guess the next step is to try to educate/persuade more voters and get it back on the ballot again.

Oh just a picture of me hanging out with some guy named Phillip...
He and M showed up at a Max Kleene concert. I quickly got in place for some pictures. Thank god I was wearing a tie... hehe.

Delicate question. Do you guys think Phillip - umm, likes his avatar?

There. I said it.

I guess it's iconic, a part of history.

MMMM blackberries! I made babyback ribs with blackberry sauce last week in the crock pot - kind of my own concoction. The blackberries were on sale, 3 pints for $10 which is dirt cheap here. Tasted them first to make sure they were ok, not too seedy and sweet enough and OMG, those ribs were amazing. Ghosty said they tasted like meat candy lol.
