I believe that the court was correct in saying that this man did not qualify as a refugee, if he had been drafted it would be a different matter but he signed up of his own free will and as such has a responsibility to forfill his contract (don't get me started on the American military violating it's contracts with its stop-loss policy though). If after signing he decided that he did not agree with this particular war he could have chosen to express his comittment to that by going to jail. If his punishment for deserting had been death or what the Canadian court decided was 'cruel and unusual' then he certainly would have been accepted as a refugee. The question that was not addressed in the trial however was if the Iraq war is in fact illegal and if this man was in a situation of having to choose between obeying international law or military law. I'm not sure if a Canadian court is allowed to address such issues but it would be interesting if it came up in an appeal. What I've heard of the aggressive recruiting tactics of the American military really bothers me, recruiting that apparently often starts before kids even leave high school. It seems that the approach is to sell the military as a happy shiny career with tons of opportunity that wouldn't otherwise be avaliable to kids without the funds or grades to pursue post-secondary education, but to leave out the bit where they also might very well have the opportunity to have bits of them blown off. Oh, and Alby, if the order to launch comes down the person who refuses to push the button may very well be the person who saves the world. |
