There is no way the Court of Public Opinion can resolve your issue, Mr. Rumpler. We have no jurisdiction, no way to judge the evidence, and we cannot hear from the defendant (Linden Lab, who will not, for obvious reasons, post here to defend their actions).

In short, you're screwed. Live with it and honor the ToS in the future.

There is no documented policy I know of that allows the use of Linden owned land in this manner, so it is probably entirely relative to which Linden you are talking to at the moment, as are so many other issues.

Told by whom? I had my little island that I put up (phantom and only encroaching by a few metres, certainly not blocking anyone sailing past) returned. I suspect Sindy had her bridge returned despite it not blocking anything and I seem to remember possibly Valerius and Brie also having items returned.

and that's just off the top of my head you realise.
This was from Blondin at one of his Zindra meetings, ages ago. When did all this stuff get returned? I remember walking over Sindy's bridge at some point. For months until a couple weeks ago, I had a huge swirling maelstrom of waves churning around my neighbor's rocks and lighthouse, where waves, rocks, and lighthouse all encroached on the Governor's water.

My sense is that if a neighbor complains, the prims get returned whether they block transport or not. Unsure about ARs from random passersby; I assumed those would have no standing, but who knows?

"....with the explicit purpose ofimpeding or interfering with the free movement of anotherResident in a Safe Areas..."

This looks like custom typing rather than some piece of boilerplate that sorta/kinda vaguely fitted the situation.

We may be missing some information here like a history or the precise location and extent.

Well, that explains it. Blondin is a ferocious liar.

I've had waves sent back myself (not on Zindra, on Nautilus continent).

Ok never expect sympathy here lol but other residents do need to know they use off sim at their peril and the sellers of said items need to warn customers that using the purchase in the off sim manner to which it is intended is actually against the TOS as per my original post. Any off sim by nature goes where it shouldn't so people just need to be aware that one day they wont be able to log-in and take that risk.

We should know by now that the L's dont communicate and have no equitable policy and therefore cannot take what they say as correct. As all off sim just makes their grid look nicer rather than gaining any personal gratification from it less commission from any future off sim purchases :)

"Off sim"

/me thinks "off grid" would be a better term. That or "off any sim" to avoid semantic arguers..

The offense was listed as harassment. Sounds like some longstanding drama between OP's alt and someone else led to the AR.

Nope single friendly (now obviously revealed as two faced) exchange and complainer had off sim too. Go figure.

Encroachment is Encroachment and it seems there has been more of it lately. Making the object phantom does not justify it to not be 100% on your land.

If you want pretty things but don't have the land for it, then get more land or buy an an island.

I do think account suspension is quite a drastic response if there really is no "rest of the story," so I'd probably appeal--not to try to get the "off-sim" stuff back onto Linden water, but to clear my record of the suspension.

One never knows when it might come in handy to have a clean record. LL sometimes uses that as a prerequisite for getting in on certain programs, so if it were me, I'd try that appeal.

Also, I can see how somebody who sells "off-sim" products may not be highly motivated to specify that it's only safe to use from a private island, out into the void (even though that's really the supposed intent of all these things).

[11:25] Blondin Linden: 8) what Linden policy is on 'Off Sim' effects like rocks and waves? it makes it look so good but goes onto protected land...
[11:26] Blondin Linden: I don't know if I would really call this policy but I asked around and got this as an answer: protected land frequently has autoreturn set on it. If the waves are located on the person's land and overhang protected land, that's fine, provided it doesn't affect system performance, and people using the protect land for sailing can get by (phantom waves or whatever).
