Hi Everyone, it's Gabi and hugs to all of you

It's come to my attention there is a new club in SL called the GSpot. I don't normally post on the forums, but I felt compelled to let everyone know that ever came to our club this particular establishment was not created by BigDaddy Wolfe or myself.

I wish them much success in their endeavor, as i know how hard it is to run a club, but I also felt it necessary to let our G-Spot family know.

Did you try to talk to them. I know some may not do research before throwing up an establishment and may not have known that the name exists already. Your spot has been around for a while and I do not see how they could argue with you. Best of luck!

ideally, sending a message to LL asking the new owner to change the name due to trademark violation or copywright infringement....

or, just IMing the new owner and mentioning there is already an established G-Spot, and that if they change now, it'll be better for both venues in the long run.

Not to say anything bad about the people that created this new G spot. I can understand that they did not know that the name G-Spot was already a club in SL, and thier reasons for making that club are way different then Gabi and mine were. Gabi and I just want everyone to know that like she said we have nothing to do with this new club, it isn't based on anything our old G was based on. I wish them luck and I hope it works out for them. Just know if it's not being run by Gabriella Molinari or myself.. it's not the real deal. It's a different club, different people, different theme, and has nothing to do with the G-spot family. Thanks for your time.

Hi, funny you should write a post. Just 2 days ago someone came to Passion Park and I saw a G-Spot title. I had to read about the group and I saw you were not in it, so I knew it was a fraud. LOL Giro and I really miss having you 2 and the original GSpot right near us in Cisco :) Glad to hear you and BigDaddy are still around :) :D

Actually, neither of those apply. Copyright does NOT protect the name of a business or product, it protects creative works. Trademark can protect the name of a business (among other things), however you do not get that for free and automatically. You have to register for it and it's not exactly cheap for the average person to spring for -- it'll cost more than the club will ever profit in this example.

So in other words, there's nothing you can do except speak to the person politely, explain your situation and hope to come to an understanding.

The USPTO search for "G Spot" appeared to produce 35 entries for "G Spot" as a trademark.

Ohhh and just to stay on topic, naming a club the G-Spot is neither copyrightable nor very inventive. Anyone claimin 'hey, there's a copycat G-Spot club in SL'....is themselves a copycat club ;)

Actually, you CAN have a trademark (not copyright) right to a club (or restaurant or other business) in RL. If you just have the one club, it only applies to clubs in the same city (or perhaps nearby ones); if you have a larger chain, your rights to the name could be regional or national. How "locality" would apply in the context of SL is an interesting question; is all of SL the same locality? Just your continent? Your sim?

However... under US law, trademark rights go away if you stop using the trademark. The original G-Spot club closed a while ago (more than half a year, which is an eternity in SL time), and thus has no ongoing rights to the name. Laws elsewhere differ; a notable example is the UK, where trademark rights last forever, at least for tangible goods. It makes the Apple Computer vs. Apple Corps case interesting, but that's a subject for a Sandbox thread.
