Well, I admit to not having read 50% of this stuff, but I fail to see the confusion.

If a picture of my avatar (my art) is published without my permission - and is recognizable as my material - then we have a few legal issues. And a few Community Standards issues.

OTHERWISE, there's nothing more to it.

If Taco likes taking photos of naughty bits, then there's nothing to stop him - unless he does it on Federal Land in real life, or in one of 11 states. If he keeps his photos to himself, then there's not much anyone can do. I suspect he can even share with one of his buddies. However, if he PUBLISHES them, as he apparently has done, without the subject's PERMISSION, as he apparently has done in some cases, and they are RECOGNIZABLE as that person, as I think a few folks have said they are, THEN there is a problem. I suspect that all you'd need do is get a Linden to look and say "Yep. That's you all right!" If it isn't that certain, then I suppose Taco can run it up a flag pole if he likes.

I haven't been to his exhibit, and I doubt I will, but if no one knows whose bits those are, then I don't see any recourse - and I would strongly oppose any attempt to create a new type of rule to cover such a thing. That kind of stuff can really backfire later.

Now, the moral implications are - of course - up for endless gossip and whinning. But I assume it's a Mature sim, right?

Guess I'll weigh in. I did go and see it, because I didn't want to have an opinion without looking. (lol) I looked at about three, and then gave it up.

First, it's tame. Second, doesn't make any difference whether it's flesh or pixels, in principle. Third, as behavior, it's rude, crude, infantile and perverse. Third, I hate these cases where I'm forced to defend the principle of free art or expression when it's rude, crude, perverse, made to deliberately shock or cause idiotic drama, or just generally full of itself. Or when it deliberately and destructively sets two principles I care about on a collision course, privacy and free expression.

It was an asshole thing to do, he deserves to strung up by his own, maybe in public, and he had the right to do it. Sigh.

In real life, when girls don't want people to see their panties or vagina, they can also choose to wear skirts. Otherwise, why not just go around in panties or commando? It seems only in SL are we expected to take the blame for not perv-proofing our clothing choices.

Art is often controversial, and if the amount of drama is proportional to its value ; then Taco's museum of upskirt snapshots is a masterpiece.

To the people who think those who'd like these picture are men in search for wank material: get a clue, there's better on the Internet. Same for those that are quick to label others with "pervert" ; upskirts are as valid a subject as anything else, the fact something sexual is depicted doesn't make viewers automaticaly perverts.

And it's art too ; anyone can make a museum of upskirt snapshots, but that doesn't make her a hack. Art is not only detailled paintings of dead things, fruits and flowers.

I just wanted to clearify one thing since some may have missed one of my previous post.

I never condoned the action of non-consent. Everyone deserves respect.

My basic view is that if issues of photos esculate into many more issues of grievances, then Linden Labs will have a Bear on their hands; and it could go to the extreme to such that complaints start getting out to media and authorities such as Attorney Generals, and it will only make it harder in the long run for a game of this mature nature to exist or get and retain clients. I don't think alot of people would like to see mature content taken out of game, and if it was somehow enforced by law, alot of people would feel their rights are in violation. I think Taco understands the views of those that would like consent and so does Linden Labs out of respect to the account holder. Basically try to avoid a Police State by not taking issues too far to the extreme or it may soon stare you in the face with Opression.

So in other words, don't complain, discuss or debate anything lest daddy take away our toys? No thanks. I don't think LL are retarded or extremists. I'm pretty sure they realize the difference between consentual adult play and non-consentual adult play, and I'm pretty sure realize it was consent that was the issue here. LL is not going to take mature content out of game any more than they're going to shoot themselves in the foot. (Or the crotch, as the case may be.)

Well, that is an unassailable argument, so far as I am concerned. If the creator calls it art, then it is art - no question about it. Indeed, the only question then is whether or not it is good art.

The purpose of art is to make some kind of statement which transcends the means utilised to make it. Duchamp's urinal, which I believe was mentioned in this thread, is good art, because it takes the most mundane of objects, and by displaying it as art gives it a significance it otherwise could never have had.

That is not what this display does. The display itself does not make it obvious that what is displayed is art, and the objects on display are not mundane - being totally outside the experience of most people. Indeed, it seems to me that this display does nothing more than any internet upskirt site. And for that reason it strikes me as very bad art.

I would be very interested to hear the artist speak about this work, to talk about the creative struggles he went through and the philosophy behind his art.

Until that time I shall continue to think of him as a wanker.

The "art" of the exhibit wasn't the crappy pictures, (I cant' believe how many people don't get this), nor the shoebox I put them in. The "art" of the exhibit was the debate, here in the forums, in game, and on other websites, about if I was reprehensible, a predator, an 'artist', a villian, or a hero; as well as getting people to discuss and think about about who and what an Avatar is, and what "rights" they are entitled to.

In that sense, I think it's very good art. Of course, I'm biased.
