90% and I am embaressed that I missed the INS question BTW just so you all know there really is no set test, the tester asks any number of questions from a group. This is to prevent people from just momorizing a pattern

The War Powers Act, passed in 1973 (I think) allows for 90 days of action taken under orders from the President, as CinC, without an official okay from Congress. While the constitutionality of WPA is questionable, IMO, it hasn't been challenged in court, so it still stands. Frankly, though, I think that Congress (both parties; remember Kerry voted for the Iraq conflict resolution) is not taking full responsibility for its constitutional duties by issuing all the wussy "we okay the president to do this" resolutions instead of a vote on a formal declaration of war.

From: Vares Solvang Notice what it says though about the real test. It's not multiple choice. Think you could pass this test if it wasn't? I don't think I would have. (The real test is given orally even!) But in real life you would have passed the oral exam since you would have spent at least a minimal amount of time reading through the booklet and doing the sample questions. So while many current citizens would fail a pop quiz, it's not too much to ask, IMO, that those seeking citizenship demonstrate a minimal amount of effort, intelligence, or respect. This is not unlike a job interview. You may not expect the candidate to be well-dressed and well-groomed every day on the job, but if he shows up to the interview unshaven and with his shirt hanging out that certainly says something about him.
