Estrelle, So sorry that it's your turn to go down this road. That sucks. It's hard for me to get too upset tho. If a designer uses real life designs and makes them for SL, (not an exact copy, but definitely a STRONG inspiration), then others may be/are doing the same thing. So, when that happens, it's hard for me to say one is a thief and the other is the original creator. Often in RL, many people will get the same idea around the same time, but only the person who acts on it, creates it and gets the patent on it, can claim the design. Unfortunately, SL has no patent system. And yet many people are getting the same idea at the same time. HOWEVER - if the prim count is the same and laid out identically (even with a small change to the layout of flowers), then it very well be a copy. If that's the case, shame on the copier. /me wonders who may be working on the same idea I am, and whether they will beat me to market. I'm glad you're over it Estrelle, best way to handle it.

I have 10 pairs of shoes in different colors that I made almost exactly like those in April of 2005 for my friends wedding. We ended up not using the shoes because they were too prim heavy. Can someone pay me for stealing my design? LOL
Lizzie you should know better than finger pointing over people "copying" designs after someone pulled the same shit on you and you didn't like it.
There are few original designs in SL. I have a pair of shoes exactly like that from 3 summers ago, are you going to pay the original designer for recreating the design in SL? Get over yourselves.

Shopping designers quality made shoes can never be a problem .. no way!

I pulling this from recollection, so add a three grams of salt. Recipes as algorithms are not protected by copyright, but the expression is. As for the ingredient lists, there only so many ways to express "4 units vodka, 2 units Kahlua, 1 unit Amaretto". For the instructions, there are many ways to describe how to bake a cake and the text used is protected but the method is not. In the case of prim shoes, there is a relatively small set of objects that are shoe-like. For slingbacks, there is an even smaller set. Sports scores are tables of numerical facts that once published become no one's property. The courts had said that doing the printing equivalent of photocopying another newspaper's sports score page was not cool though, you at least had to make your own presentation. Telephone directories fall generally into the same category: the listings are facts, but simply "photocopying" someone else's book is not cool. In my total layman's view, prim shoe designs are far more like an ingredient lists or sports scores, but as Lucifer noted, knock-offs are a fact of First and Second Life. The only practical choice you have is whether or not to get infuriated by it. Perhaps of more importance is the drink recipie above which was invented by a friend, named a "brown derby" and we were unable to find any similar concoction or any mixed drink bearing that name on the vast web. It is pretty tasty, too; enjoy in moderation, or immoderation if so disposed.

There is no room for blatant theft in SL and should not be tollerated. Estrelle put MANY hours into making this pair of highly detailed shoes and she deserves that credit. Thank you for your help. This thread is nothing but a baseless attack. Why has this not been deleted? There is nothing in SL or the RL to prevent clothing manufacturers from making similar items. This person is not a thief, you are just excitable and ignorant. Get rid of this trash on the forums.

So why are you worried? I have had items ripped off before as well, and I never made a huge deal out of it because I know that the quality of my orriginal is better and thier rip off just doesnt compare. The simple trend is most people who resort to copying are not skilled themselves and that is why they resort to copying, consequently their copies suck.

I think it used to be, with art/paintings, there needed to be around 90% simularity between two works of art. And that was before a court would even bother to get into an infringement case if I remember right.
I just wonder how exactly the Lindens deal with that. I never looked that up yet. I know one or the other gets deleted from the database but the process before that I'm a bit curious about.

With a few deletions (deleting a dangle and shift cliking another little flower on the front). Visually it appears to not be eyeballing. This post's intention was to discover the designer, get a copy rez them side by side and settle a dispute. Nothing more. Yet now it appears we are mud slinging??? Second. This has to do with principle. Whomever made the shoe obviously saw/purchsed/was given Estrelle's shoes and lacks the creativity of doing a design on their own. He/She obviously has the ability to create shoes, so why not branch out and do something from their own mind? Ebony, as far as your shoes, you did not release them. Sure people can have the same ideas and had it been their own idea this would not be an issue. A black shoe is a black shoe is a black shoe. I get that. We all get that. Nothing new by you comment regarding that. Again, we get it. Third, Ebony you surprise me dear. This 'same shite' is in reference to me having created something BEFORE that other person, was disproved with a website backing it up and my creation date. End of story. Furthermore, this other person was also accused by a major designer of copying his/her designs, and was informed of the possibility of a lawsuit. So yes, I can sure as hell point a finger. Fourth, as far as getting over myself? This was never a point of being on myself. I felt Estrelle was wronged and we want to know who created the shoes. So i took it to forums for people to read and maybe go, oh yes! I've seen those. So and so made them. Why the big drama?? This has nothing to do with stroking an ego syndrome. If there is any ego to get over with I suggest you look at the 4 fingers pointing back at you..... enough already. Finally, since no one has posted or IM'd either of us with seeing these shoes in game then I will come to the conclusion that there is no more need to read this thread, as all it has come down to is name calling, mudslinging and general disregard to creators right to protect their content. Or, you know, the person could have just seen shoes like that in a window somewhere, gone home, and made them in SL. Heck, the 'original' sl creator could have done the same thing.
Someone has already commented that they've seen shoes like that IRL, and I'll guess that company didn't just make one pair.
Isn't the whole POINT of SL to be able to look at something, say "OH, that's nifty" and go home and make your own version? We tell Noobs to do it all the time, see something you like, go home and try to do it yourself. Heck, that applies in the real world too. I sew. I spot something nice in a shop, run for the fabric district, run home and make it. *gasp* sometimes I even -try it on- to figure out where the seams should go. Heck, I might even give it to a friend or make two and sell one. I still had to make the item, it's still mine to do whatever I want with it. Am I being original? Nope. Is it still my own work? Yep.
If it makes you feel any better... I've made stuff and had people create their own version too.
