From: Ulrika Zugzwang I do. It's been copyrighted under my name since the inception of the project on my website. However, I'm in negotiations to transfer everything to the city. Let's give Claude time to do his work.
~Ulrika~ I would prefer, if it's true you are holding the copyright over our heads as a negociating tool, to change the name and remove any vestiges of your involvement. I think we need to proclaim Ulrika's project officially dead and start fresh. With a constitutional convention to start it out. And a new name and structure. Or this is going to happen again and again. She will never be satisfied. She will continue to come back and insist we are doing it all wrong and not in accord with HER constitution. She will surely find some loop hole that gives her some control.

From: Kevn Klein She will surely find some loop hole that gives her some control. The issue is much more complicated than IP, Kevn. It involves: - Initial investments - In the beginning three of us put up money to purchase a sim. However, I performed all of the in-world work alone for a couple of grueling months. I would like to see a return on this investment, much like those building the second sim will.
- Intellectual Property - I have claimed copyright over all of the IP on the website and the city name. I'm also (quite logically) the founder of all the city groups and forum. I'm very much interested in transferring all of this to the city in its entirety. If an agreement is reached no further claim will be held.
- Content - In the city I still own the bridge, I have my Fachwerks, a huge amount of custom-made textures related to the city (addresses, street names, flags, etc.), and the voting system. I'm interested in transferring all of this (including the fachwerk) to the city, including all content on my hard drive (over 600 MB).
The key thing to remember, is that it's not the ownership of the objects or the names used for the groups or sim, so much as it is a critical initial investment that made the current project viable to this day. As a lawyer might say, that's something that can't be erased with a name change. With that said, I have made an offer to Claude to transfer everything in return for payment on this initial investment. Every last byte on my computer and all rights to all IP, forever, period. Additionally, as an act of kindness, I've also offered to support the city's next RA election. I stopped listening to the little devil on my shoulder and started listening to the angel -- Kendra! I think this agreement will benefit everyone and provide closure. However, that's all on the subject I will discuss with anyone right now, so I apologize for not replying to your following comments and questions, Kevn. It's important to give us some time to think, talk, and negotiate in private. ~Ulrika~

Unless you have a contract that says you are to receive a certain amount for the work, you volunteered your labors, efforts and money. To be paid, one must make a deal before doing the work. If you don't specifically declare the value of the work before hand and receive a statement from the client that they accept the terms, there is no expectation of payment.
As for the IP, if the city walks away from the project and starts a new one, there will be no connection to YOUR project.
The content should all be returned to you in my opinion. After what has happened, I think it's dangerous to leave anything in the city with your name on it.
BTW, I'm glad to hear you are now listening to an angel instead of a devil.

It seems to me that stirring the pot to a boil again when it's just started to simmer nicely is only going to wind up giving us food poisoning, How's that for pushing a metaphor? Seriously, Kevn --your passion is admirable, but there is history here that needs to be resolved for everyone's good. I'd ask you to have some faith.

Seriously, Kevn --your passion is admirable, but there is history here that needs to be resolved for everyone's good. I'd ask you to have some faith. I'm not an officer of the government, so I'm not making any official statements. But I think citizens should voice their concerns and say what they think. I'm not trying to stir anything. I'm just saying what I think. I'm saying what I think is the best way to handle this issue. If I thought for one second Ulrika did this work with any more expectations than to stroke her ego, I would say pay her. But the truth is she isn't really as concerned with the money as she is the glory. As she worked she received plenty of glory (her pay) and never once asked to be paid in money. Then she left, presumable forever, leaving all behind. She has made contracts on this forum and didn't keep her word at least once in the very recent past, so I don't have much faith in her word.

From: Kendra Bancroft Good, Now try thinking before you say. I thought it out. It's sad you resort to personal attacks. I haven't insinuated you aren't thinking. Although I think a case could be made that you can't fairly critic Ulrika's actions because you almost worship her. You have in your store a doll for sale of Ulrika that is meant to bolster her ego, you have a "Make Ulrika a Star" shirt for sale as well. It's quite obvious there is a bias. The problem I see here is you are so biased that you can't see what she has done to the project. Clearly your allegiance is to her first, above and beyond and allegiance to the city. I forgive you for saying I don't think before I type.

From: Kazuhiko Shirakawa What she said. Yeah, at least I not helping her case at all. It seems I am making a case against her argument. And since you seem to agree with her for the most part, I would expect you to want to silence me too. I consider it a complement, it means my points are hitting home.

From: Kevn Klein you seem to agree with her for the most part *raises eyebrow* I do? I didn't think I've said much in the forums on the subject, but in general, I thought I didn't agree with her. However, given that she appears to be in the process of reaching a settlement, I thought it better to wait for that to happen before doing much else. From: Kevn Klein I would expect you to want to silence me too. In general, I tended to be sympathetic to you. But since this "who supports whom" isn't really germance to the topic of whether Ulrika is an officer of this or that group, or which IP belongs to whom, perhaps it would be better to take this to private conversation. Unfortunately, I can't find a way to contact you from your forum profile; I suggest you send me email if you'd like to continue this conversation.

I'm sorry if I seemed rude. I was up late and can be a bit whiny before my first gallon of coffee. I don't do private chats on the forum, though I accept IMs in world. I tried to strike a deal with Ulrika in world. I handed her 10k and asked if that would let her rest in peace. She seemed OK with the amount at the time, but returned it insisting it must be official. I told her that she should keep the money and send her stuff to the public trust, that it's just a donation from me to the city. I never heard another word about my offer. I think what she really wants is to run the show. She demanded Dianne be removed from office and other things that she shouldn't be concerning herself with. If it's the money, then why not keep it and rest in peace? As a citizen, I think it's my place to say what I think. If doing that is going to crash a deal Claude is working with Ulrika (I think he'll need the approval of the rest of the government though) then that deal must be rather shaky. Again, I apologize for being bitchy.

I agree. It's encouraging to hear that this is N'burg and Ulrika are negotiating over the whole kit n- kaboodle. When she's approached as a willing participant, I think Ulrika is often generous to a fault, and I don't expect that her terms will be unreasonable..... However, I exected her to hold out the IP rights against Neualtenburg, as leverage because she feels wronged in the matter of the trial.
I still think that the issue of "Neualtenburg Projekt" vs "Neualtenburg, the city" is something that needs to be resolved.
I'll hold myself as "cautiously optimistic" at the moment, though if this does all blow up I'll of course say I-told-you-so..... loudly. If this is settled without more to-do, and especially without bleeding out into the RL court system, I'll happily admit that I was wrong.

I've decided to settle everything, including the IP, all at once. If the deal is accepted, I doubt I would contest the trial any further. From: someone I still think that the issue of "Neualtenburg Projekt" vs "Neualtenburg, the city" is something that needs to be resolved. This agreement would transfer that ownership from me to the city or Kendra, depending on the group. I'll allow them to sort out the finer details amongst themselves.
