As written it is completely irrelevant if the owner takes a cut of the pot or not. Skill is irrelevant as well unless the game is a game of pure skill, i.e. there is no involvement of an element of chance that can affect the outcome of the game. In practice, Linden Lab, notwithstanding what its own policy actually states, allows the use of slot machine variants where both skill and chance influence the outcome of the game. These games, including Zyngo, Slingo and Devil May Care, all allow the owner to take a cut of the pot.

i have played a sploder and the rules were... all u have to do to play is click on the ball and your in.. u can donate if u want to but it will not improve your chances of winning... so if i wanted to donate to it i could but i didnt have to and i tryed both ways and i won when i didnt donate and i won when i did . so i dont see anything wrong with that type.. anyone else?  i havent seen this sploder around in months just wondering if its banned now?

Poker.. is a GAME.. that is a CHALLENGE... and takes quite a bit of EFFORT and SKILL to win.
Poker, is illegal.
ANY scripted device that accepts payments, and utilizes any seemingly-random number in order to affect who wins.. is illegal. Whether it be the draw of cards, the roll of the dice, the turn of the tumblers in a slot machine.. the randomly selected person in a sploder, etc.
Basically, any game where you have to risk something for a "CHANCE" to win anything of value (not neccessarily money)... assume it's illegal. This may even apply to a "claw machine" or a "grab bag vendor" (pay L$ X and receive a random item).
That may not be 100% surgically precise accurate in practice, because the Lindens REFUSE to be precise about what is, and is not banned.. and as always, they excercise some judgement in terms of what's tolerable on a case-by-case basis. But if you steer away from displaying any games that meet such criteria, you should be well safe in terms of the gambling ban. um no poker is a game of chance. no matter how good you can read cards it is still playing the odds..your effort does not determine the outcome..chance does.. legal spoders do take effort because you are either answering a question or chasing dollar signs that pop out when it explodes..the more you catch the more money you get..with poker you are not in control of the outcome with games of skill you are..
