From: Teemu Sands I have an issue. My ex rl and sl ex has decided to use his profile for attacking me 4 months after we have broke up. He has put my full av name in his profile under picks with real life pictures of me. I have reported him my freinds have reported him and the pictures remain. What part of this isnt against the rules? I have read the community standards over and over and I dont see how or why they are letting him keep REAL pictures of me in his profile without my permission. I dont even have any of me in my own. Any help with this would be great, the man is doing eveything he can think of to make my life horrible, and LL letting the pictures remain is not helping. Do you look good in the photos? Honestly most people will see this for what it is.. But LL should act on this shit quickly.. but I guess they to busy changing the webpage.

If you aren't doing it already, you might want to mention this in your ARs. It's just one more thing that might make LL move a little faster on this.

What an awful, immature thing for someone to do. I suggest you keep ARing until the picture is removed. Have your friends AR, too, as it's been my experience in the past that the more something is ARd, the faster the problem is resolved.

More AR's filed and still there this morning and he keeps changing the text just adding more crap to all of this. Someone in Second Life is providing information about another Resident's "real world" life. Nobody in Second Life may distribute any information about another Resident's "real world" life. You cannot reveal someone's real-world location ("Bob Avatar lives in Canada"  , gender ("Bob Avatar is really a woman"  , religion, appearance, age, marital status, race, sexual preference, etc. You may not use notecards, textures, chat, IM, forums, or any other means of violating privacy. Linden Lab will attempt to delete such privacy-violating content, if possible, and will apply appropriate discipline. He is using a TEXTURE in his profile. I am just so shocked that they are LETTING him do this.

A disgraceful situation. Both that someone would stoop to doing such a thing and that LL aren't wiping the guy's account and banning his sorry butt. Hope you get it sorted soon. In i.e. Germany and Austria this would fall under the anti-stalking law. Other violations of your personal rights are involved too. The person is not allowed to publish these picture(s) and other infos about you against your will, even not if they are nice and just for documentation that the person was once related to you, or for whatever "reasons" that may happened. LL should react on this immedately. It is clear against the above by others mentioned ToS rules and against RL-laws in general in the most western countries AFAIK.

As mentioned above, a problem with ARs is that so many are filed (and a lot of them BS, no doubt), it takes time for them to be processed. LL does not have a staff of thousands eagerly waiting for the next AR to pounce on.  This is absolutely and clearly against LL's TOS and against their policy, and as soon as your ARs get attention from LL, I'm confident that they will take care of it -- or, they'll try to. But don't expect immediate solutions. I'm guessing that LL's response will be quicker than you'd get in RL courts. It's too bad they can't handle it more quickly, but please have patience. Filing too many ARs for the same thing might work against you, BTW. There are a number of crazies filing ARs left and right. You're not one of them, but you don't want to look anything like one of them! Oh, glad to hear you tried asking first. It's a shame that wasn't sufficient. When did you file your first AR? In my post here, I'm assuming it was a number of days. If it's been weeks or months, then something's going badly wrong here.

That's a good point, but I still think that the CS very specifically disallows revealing RL information without permission. Giving someone a photo, even with full permissions, is not implicit permission to use that photo in violation of this point in the ToS. From the Community Standards, referenced by the ToS: From: someone Residents are entitled to a reasonable level of privacy with regard to their Second Life experience. Sharing personal information about a fellow Resident --including gender, religion, age, marital status, race, sexual preference, and real-world location beyond what is provided by the Resident in the First Life page of their Resident profile is a violation of that Resident's privacy. Remotely monitoring conversations, posting conversation logs, or sharing conversation logs without consent are all prohibited in Second Life and on the Second Life Forums. This clause makes no mention of the permissions system, and in my opinion, is not limited by it. The only way out would be to claim that a photograph is not "information". From the standpoint of information theory, it certainly is. From a legal standpoint, maybe it's not. Still, my money is on LL calling this a violation.

The last AR was this morning before I came to work, the first 3 days ago. If you still live anywhere near the guy....you need to start keeping a diary and account of everything that happens. The SL problem is an indication of problems to come. The more you have organized and documented, the faster a process will go, if you need to shut him down in RL, too. You might want to take an hour at the police station to review your local stalking laws and remedies with someone, and also to get a file started.

The core of the issue is the disclosure of RL information. That's a no-no. It is independent of copyright, texture permissions, etc.
The main reason that suggested the DMCA route was to fast-track the issue to a set of LL eyes that would look at it differently from J.Random.G-Team.Linden when the AR(s) got to the top of the queue.

However, in this case the lady concerned did NOT pass the photo to the other party within SL, so I believe that displaying a RL photo, without permission, could be argued to be a Disclosure violation, if it can be shown that: a) the list provided in the TOS was not meant to be an exhaustive list, but examples only, b) and if a photo can be considered 'information'. Regardless of the technicalities, a photograph is RL information. I'm not clear how sharing a photograph you were given, and have been asked not to do so, is anything but disclosure of RL information.
Are permissions even relevant when putting the image in the profile picks? Even if you make an image no transfer, which makes it clear it is not to be shared, that won't stop anyone you give it to from putting it in their profile, or on a prim in-world.

The community standards state you cannot reveal a persons gender or race, pretty sure a picture of me up in his profile is showing both. Besides the fact it was not a texture given to him in game, he is doing it to harrass me and it is my choice if I want the rl me out for anyone in SL to see, not his to make for me not anyone's to make for anyone. That is the point.

Well a Lotte Linden a supposed "friend" of his sent him an email warning him to remove the information and that it WAS a breach of the TOS or they would ban his account. I found this out due to him gloating he got away with it. I dont care to be honest as long as it never happens again. He did remove the picture. It is good to know that it WAS a violation of TOS though  Thank you everyone for replying and the kind words *hugs* Hopefully this is the end of it. Great weekend to all!!!!
