Postin RL PICS of another in your Profile

I have an issue. My ex rl and sl ex has decided to use his profile for attacking me 4 months after we have broke up. He has put my full av name in his profile under picks with real life pictures of me. I have reported him my freinds have reported him and the pictures remain. What part of this isnt against the rules? I have read the community standards over and over and I dont see how or why they are letting him keep REAL pictures of me in his profile without my permission. I dont even have any of me in my own. Any help with this would be great, the man is doing eveything he can think of to make my life horrible, and LL letting the pictures remain is not helping.

This truly sucks. LIke.. really really sucks. Guess it' just goes to prove that unless it's about money or protecting their image.. LL does not give a FAWK about the basic user

What category did you AR it under? I would think this would fall under Disclosure > Real World Information, although I'm not sure how LL would handle pictures being displayed without permission. For things like phone numbers and addresses, they would be on the user like a shot, but I have no idea what the response time would be for images.

this is really uncool, if Linden Lab allow this to persist it doesn't bode well for anyone using SL as a platform, businesses beware.

Threaten to sue LL if they don't enforce their own rules regarding residents disclosing personal information about other residents. That is a BANNING OFFENSE there, and if they are ignoring that, you would have every right to sue them as being an accomplice to that divulging of personal information.

I don't usually reccomend taking things outside the normal abuse report procedure, but this is a serious enough violation that I would. You might try a phone call or to reach out to one of the specific Lindens in email. I used to email some of them occasionally but have forgotten the format.

Anyone out there have a good way to contact LL outside of an AR?

Apparently LL take note of those.

I agree the DMCA route is probably a good way to get another pair of linden eyes on the issue.

This is unreal.... how can they not keep the gen. user safe in SL and our privacy.

He is using various pics changing them daily some of just me some of me and him, I have reported an AR a few times using the disclosure route. I have also called LL's main office its a maze of voice recordings pointing you to the website the only real people you can get on line is of course the billing office.

Public disclosure of private facts -IS- a tort that he can be sued on, and LL can be joined in the lawsuit as co-defendants if you want to rake in the millions and can show they've failed to act within a reasonable amount of time...

This is not just against the TOS, its against real world law as well.

For now, AR the heck out of it - under multiple categories, file the DMCA (see below), and put in a support ticket.

I say file the DMCA because he has also committed the tort of appropriation. Ie: He has appropriated and publicly used your 'image' (not just visual, can also be your rep, name, brand, etc) without your consent.
- That's a second privacy tort.

Get a lawyer, sue. That's honestly where this one stands. You have real world legal rights being violated here, for which damages can reach into amounts way beyond a few lindens.

If you are a premium account you might try Live Chat... not sure how much help that would be but the worse they can do is say no and then you can file a DMCA against him ;)

Filing the DMCA then right now, I am not looking for money out of this I want them to follow the rules they put out. I want him to get my image out of his profile period. He is getting a great kick out of them not doing anything trust me.

Its not about winning money.

You don't sue, even for money, to win the money - you do it because it changes conduct.

Chances are, 3 seconds after a letter from your lawyer hits the desk of LL's Legal, you will get a mountain of support on this issue, and the person doing this to you will never so much as make it to the secondlife.com website again...

But do try every other recourse first. LL's wouldn't be liable unless they could be shown to not have acted reasonably. That said, as for the person going after you - sue him now. He won't stop just because he gets booted out of SL.

Occasionally I've had an RL pic of me in my profile and I did have one up in my home for a while. This thread has made me think twice about putting any RL pics of me in SL in future.

people that put up things like that of other people should be perma banned..
It's one thing to be about an avatar but when they use RL things just stuff them in a barrel and toss them overboard..
Thats just a step too far in my eyes..

BTW, I assume you asked him to remove it already. That's the first step.

I doubt the rights to ones own likeness is covered under DMCA, but in SL they use the DMCA route for a lot of things where it doesn't (legally, technically) apply.

I don't think you need to threaten to sue LL. Not unless they fail to respond.

She only owns the right to her own likeness under the limited context of rights of privacy and publicity, not copyright. Copyright for photos initially belongs to the photographer. Unless the photographer assigned copyright to her, copyright is not applicable in this situation and therefore neither is the DMCA. She should still file under DMCA with LL anyway to get its attention in the matter but ultimately LL should act under violation of disclosure. If this is doing her serious harm, as in legally measurable harm, she should consult a lawyer about filing a privacy claim and getting an injunction if LL doesn't eventually take any action to stop this. Hopefully it wont have to come to that.

I have asked him a ton of times to take them out and knock it off he says no. I filed 4 more AR's tonight its still there. I faxed the DMCA paper today, its still there soooo, I am seriously disappointed that they have let this go on. Some of the pictures he has used I did in fact take myself. The one in there right now is of both of us and that one was taken on my camera by a freind, but it shoud not matter that is ME in there without permission with me asking for days for help to get it out and him just getting away with doing it. I have seen the abuse report thing LL puts out with what people have gotten in trouble for they seem to be more worried about nasty avatar names and the like than this.

BTW I am in the middle of getting a restraining ordered filed because this isnt just an SL issue he is harrassing me every way he can think of.
