Should you be able to Sell your Avatar?

Ok..this another subject of rights and who they pertain too.

Blake - You already can and many already do. People sell the literal look of the AV and AV prostitution is rampant. What more on an AV can be sold?

Oh yes, I forgot - pictures of their genitalia.

hmmm... If pictures of an AV's genitalia can be sold, then is photographing them without permission stealing?

Is my fault in this case Sensual. I suggested he make a new thread poll because his last one was so vague, but this was *really* the question he wanted to ask. And for the record, I personally think that Blake comes up with some great discussion polls. Yeah, sometimes I want to roll my eyes, but I've seen some good talks come of some of his questions, so I'm willing to let his "silly" ways slide. Just my opinion though!

Well, I really don't know the guidelines concerning the selling of Avatars.

Blake, do you mean selling your avatar as in virtual prostitution, or do you mean selling your avatar to a real person? Meaning, you sell your account to someone who would like to play in SL under your name?

Example: Selling your Avatar on Ebay.

You put your account up for Auction on Ebay and the winning bidder gets your account information to access the Avatar and becomes owner..which is questionable. Think really hard.

I see. Well, I don't know who on earth would buy it, but I'm against it. Why? Because if it was legal, then it would take away a lot of what is special about SL -- the expression of the individual in a new world. If people could sell their avatars, then it would be tantamount to having an alt, only the other way around. What's the point in that? Why bother selling an avatar? Where's the market for it?

And anyway -- harking back to something you said earlier -- our avatars, while technically it is we, the customers, who control them -- it is LL that owns them. Therefore we cannot legally sell them.

Blake, if you're especially interested, I have an alt that I'll sell you for, say, $19.95 + s&h. If you have a need for larger quantities of avs, I can probably arrange it, and might even be able to cut you a $1.00 per av discount if you buy them in lots larger than 20.

It's a great price, I tell you, and I can guarantee that these avs are in virtually new condition. They are also devoid of Id, and Ego, so feel free to humiliate and abuse them in any way your heart desires. Upskirt photos, slave-bondage sex, they'll do whatever you make them.

Ok. Let me throw something into this mix. Lets say a person wants to sell their avatar to another person. And their avatar is wearing a skin and parts created by someone else. Who owns the creative rights to that skin and/or those parts? The owner of the avatar, or the person who created that skin and those parts? Can this avatar sell a model of itself to a magazine that features online avatars? Even if every part of their body was not created by them?

I dunno. Is an interesting thought though.

You can sell your Avatar - in any way you want - your avatar is content , created by you, and thus you hold the IP rights to it (as mandated by LL) - and when it's fixated as data you also hold a copyright.

Now if you were talking about your ACCOUNT, which is a totally different entity (one you didn't differentiate between on Taco's thread) then the answer is NO - as is written in the TOS.

While some of your ideas/polls are interesting, I am starting to really wonder if you are doing it to get a job at LL or are just craving the attention. If this keeps up Blake, your gonna find someone who wants to stick these polls straight up your as*! I won't, but someone may eventually. Perhaps you just like the abuse is all, I don't know? It's a shame is all that you feel the need to constantaly make polls like you are maried to them or something, but power to the people though.

Hmmmmm I just had a thought here. Perhaps thats why you had a "Bounty" placed on your head in the first place in the game (which is silly in my mind)? My suggestion is to find a special one in game to share all this energy with Blake, cause from my point of view, it looks like ya may need one............

You hit the nail on the head. Though understandably we will look at a picture that is taken without consent as invasion of privacy and much emotion that one conveys as if they were the avatar, it is not logical to get overly emotional, however; Ironically in reality one does not look at the TOS broken first, but; they look at it as a personal infringment, when in reality it is a TOS issue of Company Policy.

As you can see with these two Polls and how they relate "Virtual Law" and Virtual Rights" should we have them?" and "Should you be able to sell your Avatar", the Poll results are contridictory. One wants the right of ownership because of time and emotional attachment with being able to sell, however; ironically the other accepts the guidelines of the outcome of Judgement from Game Company and not legal representation concerning defense or prosicution. Just evaluation.

Point taken. A very fine distinction, and one that will confuse many for generations to come.
