You are not alone in your frustration Willow.

Ferran and I (Phobos Design) recently found one of our best selling pair of boots had been copied (badly) right down to a similar name. We found this out when a number of our customers sent us irate IMs (along with pictures) telling us about the rip-off.

Unfortunately... it's not technically a rip off. We know it's a copy. They know it's a copy. Anyone who sees our boots and compares them... with the creation dates, knows it's a copy... but there is nothing to prevent that in SL. Unless it's an actual texture rip off via an exploit, the TOS doesn't cover it. The same is true in RL actually unless you safeguard an idea through patent.

What bunk. Originality only doesn't work if: 1. you do a lousy job of marketing your originality, or hiring someone to market for you; 2. some party or parties controls awareness and all distribution channels to the customer; 3. there are serious barriers to entry that block out alternatives (think Microsoft OS and bundling/compatibility issues).

Now, it's probably harder in some ways to get the word out about new products than it used to be, but the community is not so big and economy so mature that ANYONE owns the distribution channels to potential customers.

Originality may not be EVERYTHING ... ie it's not enough to be original and declare yourself the market winner, but it sure can be profitable!

That said, on Willow's post: if the stuff copied is general ideas, like "ninja av" or "braided hair" then "copying" is to be expected and the ideas are so general it really can't be considered copying. But if you're talking about really specific stuff, Willow, like a particular piece of clothing with a custom texture and custom accessories, and someone is just copying to get around paying, then that sucks and i can understand why you are pissed.

Object creators: don't try to fight copiers by screaming and fighting and trying to get them in trouble with SL admins. Start off with the assumption that there is no way to actually prevent anyone from ripping off your idea.

Instead, fight this with smart marketing. It's just like in RL. Does that watch look like a Rolex? Yeah. But is it a REAL Rolex? No, it's a cheap imitation. A knockoff, like Sam's Club has "Dr. Thunder" and "Mountain Lightning."

You have build up name recognition and attach value to an item because of where it came from. That's how 99% of RL businesses operate. Do I want "Niko" shoes or "Nike" shoes?
