um... another thought that this post triggers... does anyone already have a business named Wet Pixels?
If, let's say, I got a 'friend' to craft their avatar to look like a famous person or even just another avatar from SL .. and then we had pixel sex .. would that be OK? To comply with the TOS, would I have to do it out of sight, or could I have a mature event where people can come and watch? What do you think? Discuss! _____________________

IIRC Weird Al has to request written permission to parody songs. In one case he got in legal trouble, even. That's because, legally, Al's songs aren't parody. They are humerous adaptations. Now what Mad TV does, actually making fun of the original artist, that's parody. and before you answer "Al makes fun of the original artists..." I have every Weird Al album. I know exactly what his songs do (and don't do). "Yoda", for example, in no way parodies the original "Lola." It's simply an adaptation that has humerous content. |

An individual's likeness is owned by that individual. You must obtain permission to use that likeness in any sort of commercial or public exhibition. In the privacy of your own SL living room, nobody can say what you can and can't do alone, or even with a small circle of friends. But the instant you put on a show or you sell the avatar for L$, you are violating copyright law. |

I say for halloween we put peoples names in a hat (not a w-hat thank you) and draw names. Whomevers name you draw is who you'll be for halloween. Then we have a big party and try to guess who is imitating who. And if you get lucky you might just take yourself home.

Ironically, Blaze would be taking a bigger chance cloning another user's AV than some other RL celebrity or image because...we're HERE!
While LL will remove trademark violations automatically, they will only remove copyright infringement after a DMCA claim has been filed, and only the owner can file that claim. While David Hasselhoff may not know (or care) that someone is using his likeness in SL, an actual SL user/celeb may respond immediately. Oh and <3 Iumi <3 _____________________

Hrm. So having sex with an entire *avatar* likeness presents issue, yet no one has qualms about random 1 prim texture mannequin humping?

I love that idea Kris! I have a Michael Jackson avie I made and wear, hanging out at the hubs complaining about germs. asking where the children are and in general creeping out everyone. Jacko is available. hehe That sounds like fun. What other celebs need to have their sphincters expanded? What about the lawyer that's griefing the video game industry, Jack Thompson? |

Well in the TOS or not, given the thread title, it's a least a little scary ![]() Granted, my question does not fall within the scope of the original topic; however; the question does begged to be asked since, like a certian Other MMO, one may create exact likenesses of copyrighted intellectual property. News Link One News Link Two Just not as easily as one can with the character generator inside the Other MMO. I'm guessing that this would fall under "fair and acceptable use" as long as the creator of said avatar did not sell it L$/USD. _____________________

Well, since celebrities are paid for their likeness used in videogames ... my response would be ... it may not matter what the TOS says - this could be a matter of copyright infringement.
Weirdness, eh? _____________________
