Would it be ok by the TOS to have sex with an avatar likeness?

If, let's say, I got a 'friend' to craft their avatar to look like a famous person or even just another avatar from SL .. and then we had pixel sex .. would that be OK?

To comply with the TOS, would I have to do it out of sight, or could I have a mature event where people can come and watch?

Why bother with public opinion. Test the system out with a Philip clone, shouldn't be too hard to do. Do him any way you want to. Send him the pictures and videos as a courtesy prior to public distribution. Let us know, k?

I guess some lawyer could argue that a celeb's appearance construes (eeech, big word) a (marketable) brand and as such is protected by intellectual propoerty laws ? I'd say as long as you do that in private or make sure no one can confuse the avatar with the actual person, it's OK.

I can speak from very personal experience that it is NOT protected. To answer your TOS question, blaze, I can tell you with near certainty that you are NOT violating TOS by doing so, but if there is a perception that you are (and cat-calls/abuse reports from an ill-informed mob), you will be punished by an over-worked, paper-pushing system which doesn't have the time/desire to actually research charges against you.

IIRC Weird Al has to request written permission to parody songs. In one case he got in legal trouble, even.

He does so because it is easier, not because he has to. Parody and Fair Use has to be determined on a case-by-case basis and, without prior approval, can result in a lengthy court case. In order to remain topical and to avoid wasting his own time, WA simply asks first. :cool:
