Regarding /139/a8/137555/1.html.

In Robin's reply, she states that the intention is to offer refunds "any time the service is unavailable for a minimum of 24 hours". Since the TOS makes the definition, "The Websites and Linden Software collectively constitute the 'Service' as used in this Agreement.", would the website also need to be unreachable for 24 hours in order for users to qualify for a refund?

As it stands, as long as the SL.com website is reachable, no refund need be given for downtime regardless of how long the SL grid itself is offline. Is that the intention?

Our original thinking was to provide credit when Second Life itself was inaccessible for an unacceptable length of time. i.e. more than 24 hours. It looks like we need to clarify our language, and also take another look at the role the website plays in the SL experience.

I have often wondered about downtime caused for anything other than scheduled maintenance having an impact on SL based business. I know that in real life, in certain places at least, if something interupts normal business, ie a gas leak or major roadworks, someone is liable to pay compensation.

Now my business just pays my annual fee, which is fine for now (its fledgling, give me time!) but for those who make a lot of money, an hour or two is a major amount of time for their business to be offline. Many large web-based companies fine their hosts for downtime, surely we should be able to as well. Now, granted when I'm making around L$1000 a day on average (recently at least) an hour will make L$41.66 difference, which equates to roughly US$0.46 if bought in so its barely worth it, but what happens if you make L$10,000 or even L$100,000 a day, which I'm sure some do. We're looking at US$1.82 or US$15.43 an hour. Starting to get more interesting now. If you start waiting until 24hours is passed, do you give us 24hours lost earnings? L$10,000 = US$36.67 and L$100,000 = US$363.94

Now I'm not familiar with the policy of refunding money, I haven't looked it over its true, but it's still a concern. In the (unlikely) event that I'm ever making that kind of money from SL, I'd like to know that even an hour's downtime will have me covered, losing US$363.94 a day would be quite a hit on my SL business and it's not reassuring for those pioneers who are taking the virtual market in SL to these amazing extremes
