I don't see why Linden Lab shouldn't compensate you Beau.
Linden Lab simply creates this money so they wouldn't suffer any losses at all. Here is the good news, the resultant devaluation of the Linden Dollar (and subsequently, our losses) would be very small. So small, it wouldn't be unethical! You should take out an ad over at SL Herald urging users to turn their backs on Linden Lab. The Lindens respond very positively to those tactics. _____________________

In retrospect, isn't that really what this whole telehub land buy back was about? Setting a legal precedent in a virtual world? When I read the results of that settlement it seemed so lame that SL was not really being punished, but then I started to ponder what the long term effects would be.
That makes ME a sad puppy. It kinda takes the imagination and fun out of a second life when it starts becoming first life in a virtual space. ![]() _____________________

Blaming the victims of one action who receive a settlement because others slept on their rights, or did not have a case, is intellectually dishonest and improper. This sour grapes tactic can only lead to a closed society where no justice or recourse for wrongdoing exists." Please note, this poster specifically used the term "settlement" and yes, the compensation is in linden which does nothing to punish SL for doing what she said they did. Litigation is now a reality in SL. _____________________

Litigation is now a reality in SL. I don't believe that the P2P settlement is what brought the potential for litigation to SL. As soon as Linden introduced the ability to convert L$ to US$, and created the ability to generate real world income off investment of time & money within a virtual space - litigation became a posibility. It just took a while for it to gel. This is nothing sudden, IMHO - the posibility for this to happen has existed since 1.2 We can't have our cake and eat it too. _____________________

I guess I'm one of the people she's talking about in post #2. I see no reason anyone should be compensated for their own unwise decisions. -Ghoti I am in 100% agreement with that statement. I THOUGHT the TOS spelled it out clearly that SL is not responsible for losses due to changes in the platform, but she nailed them on an advertising ploy. Basicly, what she did was get it in print that SL can be held responsible for what they "say" even if their tos clearly states they are in their rights to do what they need to do to better the system. You will see them choose their words more carefully in the future. And Travis, I don't disagree with you the potential was always there. The potential for ANYTHING is always there. What I am saying is that, it is now here and no longer potential. It was inevitable for those running businesses to have a means to enforce contracts. It just takes a whole lot of fun out of this world for people like me that come to just enjoy and do things on the hobby level and maybe cover the tier payments. All the parody threads have been quite funny, but I assure you, there are some people with major financial investments in this world taking notice of what this whole buy back was about. I think I should stop posting about this as it depresses me and I'm hormonal enough this week as it is. ![]() _____________________

LL created and marketed telehub land during the same time they were writing the code to make telehub land go away. Because of the timing, this is fraud, sicne the consumer was not getting what the consumer paid for and LL was capitalising on a mis representation. The TOS will protect LL from many things, but you cannot by agreement or waiver, get out of committing fraud.
Legally I think the argument is solid and correct. I disagree with the buy back as a good thing for LL, because SL is not selling off the telehub land, and LL could do soemthing with that land that returns the comparative value, and people who get the buyback will be able to repurchase the land at lower costs and then realize the benift should LL do something more interesting with the land than infohubs. Legally, speaking tho0ugh, what LL did was wrong. And LL owned up to it. _____________________

You know, it may just be karma for selling gestures. I have never been so close to killing a puppy in a mad rage due to people thinking that others want to hear sound clips from shows and movies we've seen a 100 times over. Incase they think we didn't hear it the first time, we will hear it 5 more times in the next 5 min.

Are you saying that LL auctioned off sims with a telehub in them for higher STARTING prices than were asked for sims without telehubs in them? If not, just because competing landbarons drive an auction price through the roof due to preceived value of the telehub does not give that telehub land any more REAL value than the surrounding land. If they are auctioning for higher starting prices, I was not aware of this practice. If this IS the case, well then fine and dandy, I see the legal problems you state. IF, however, the sims were auctioned off at the same starting price as any other sim and were then parceled and sold off by landbarons, well, then I do not see this as a LL problem. I can see this argument applying to MAYBE the people that have owned telehub land from the time when LL was auctioning individual parcels and purchased it directly from LL at a higher starting price. But these would have been from LONG before LL had plans to remove the telehubs. Okay Jake, I am going to ask you directly and I hope to find clarity on this issue. DID LL BEGIN bids on telehub land at a higher rate then 1000 USD OR are you saying because they didn't step in and stop people from bidding up on these sims over and above what non telehub land was selling for in final bid, that some how constitutues fraud on LL's part? There is a HUGE world of difference in what one calls fraud and what is just stupid buisness choices. BTW...according to the Terra Nova article, as with all settlements LL did NOT admit liablity in anything. They scored one for PR and paid folks off in thier own currancy, not USD. This was FAR from a resounding slam dunk on them, and in fact, like this world we play in, it is really only the illusion of a win. I do appreciate your comments on this not being good for LL in the long run. That land is recylable just like everything else in SL and while some may have paniced over this issue, others may find a new attraction to it and do as well if not better and for cheaper. _____________________
