Sploders that secretly give the house a "percentage"?

I was a huge spolder player and did quite well. What the OP posted reminded me of the time when my friend's club was open and they ran a spolder. I found it interesting that it would pay an avie that not there nor was ever there. How would I know this, well I would keep track of the participants because in open chat it would list their names and amounts they contributed. Also I would congratulate them. When it went off, in open chat it would mention a player receiving a payout but wasn't there. Rather than question my friend about this practice and risk losing the friendship. I decline to participate any further. I will say to his credit, to boost participation he would put in 100 - 500L. But, that non-existent player/winner just really irked me.

Figure it out or accept the loss, basically. It's survival of the fittest, which doesn't always mean the most poofers and business in a box lights and Best in LateXXX contests. It's a tough business but enough people seem to be able to make it work. As long as no one is using force or fraud, the government should not be deciding what is a legitimate business model. Unless the OP was forced to play or the sploder said it was a 100% payout, then neither of these conditions were met.

Sable, some...no...MOST sploders pay out people who paid in and then left. It's not that they are non-existent, or shills, they DID pay in, and then left.

all older sploders and most of the new ones the house always got a percentage of the pot.it was up to the house if they wanted it or what percent they wanted..but there was always a cut.

Whether it said so or not I always figured the owner got a cut of the sploder pay-ins. In fact when I contribute to the sploder I consider it a donation to the club. If I get back more than I pay in, well great! If not, it was a contribution to the club or to someone else having fun.

The clubs most likely to turn a profit are ones with some kind of overriding theme, and an unobtrusive mall or set of vendors supporting that theme. E.g - if you go to an Irish-themed "bar" which has vendors for Irish dresses then it might turn a profit. A club is perfectly viable as an engine to fuel sales if it's done right. Or the other way around, a good store with space for regular parties could make a great club, and it increases awareness of the product(s)/brand(s).
If your plan is: 1. Set up the 659,131,312nd instance of generic club Y 2. Pop a few dance balls out. 3. Add some illegal sploders into it. 4. ??? 5. Profit
Then stage 4 will read "You're not getting any further than this, trash the above".

Maybe I'm stupid... OK nevermind I AM stupid... but I just assume if I go to a club and there is a sploder there out in plain view then it's not in violation of TOS. So here's my question... if I play and illegal sploder, am I violating TOS or just the owner?

If sloders take a percentage they should indicate that.
The op said in his case it was shouting it had a pot of 33K lindens in it but only paid out ~22K.... it should be set to shout 22K pot.
It's misleading to have thier sploder indicate the "pot" is 33K.. the "pot" should not include the house cut.
Imagine playing poker in vegas and there is 33K in cash on the table ... you win the hand and all of the sudden the dealer reaches over and takes 10K out and gives you the other 23K... more than likely gunfire would ensue....

Oh I know this because I have been paid when I left. I am talking about for example 10 people are in the club and all 10 plays and it is reflected in group chat. The spolder goes out and 11 people win. Although only 10 people played. That is what I am talking about.

To ban you for stating the simple truth shows that they're being intentionally deceptive. That's a good clue to avoid the place! PM or IM me the name of the place, I just might go have some fun. Jerks that do crap like this deserve ... well, I won't go into that. You fill in the blanks! But it's not a TOS violation or anything actionable.
As mentioned above, this isn't "cheating", it's just a pretty big cut. I've seen sploders where the house actually kicks in money each time, to attract visitors just as camper chairs do.
By the letter of LL's rules, spoders should be illegal, but for some reason they're turning a blind eye to them. If there's any logic behind that, I haven't heard it. Of course, LL doesn't go by the letter of their rules anyway. Policy application varies depending on which Linden goes to investigate a claim.
So, you might try filing a gambling AR, if you're feeling vindictive enough. I'd advise against it, since most likely you'd just be asking for trouble. But one never knows, LL just might consider *this* sploder to be gambling. One can only guess, since their policy is applied in such a haphazard manner. (It's internally inconsistent, actually, giving the "rules" and then a list, and the things on the list don't agree with the rules.)
I feel for LL here, though -- they wanted the gambling ban like a hole in the head. But they quite reasonably feared they'd lose credit-card fundting, thanks to a US law.
