Reminds me of Microsoft and the shrink wrapped EULAs which couldn't be read until after the product was purchased and the shrink wrap removed (rendering the product non-returnable). Pretty sure Microsoft lost a few points on that one.

In this case though, we have a person sitting on a lucky chair to get a free product. Chances are very good that this product did not come with any terms whatsoever that the recipient was bound to. It did happen that it came with the transfer bit on. The creator then at a future time decided to impose limitations on the recipient's use of the product, after the product was already in the possession of the recipient. In any real world proceeding with real world product, this situation would have warranted summary judgement, finding for the defendant.

It's very much the same as me winning a bicycle in a drawing, and because I already have a bicycle that I like very much, I sell this one at a garage sale. It is my property, and although it may contain proprietary technology belonging to someone else, its primary tangible purpose is to be a bicycle. And I'll do whatever the hell I want with it, short of reverse engineering the underlying technology and selling that part of it.

One is only bound by a license to which one agrees. Agreement can be something as simple and easy as an act: "By taking this item, you agree to the licensing terms that go with it." *Assuming OP is telling the truth* Negative. How would his wife remember what she did and did not get at a lucky chair? As far as she is concerned is she wants to sell off all the items she can, and that would be her transferrable ones. It would be a whole other story if his wife was purposely going to this persons lucky chair and harvesting it`s inventory for the sake of resale. That would be an extremely unethical thing to do, but according to the OP, that is not what is happening.

Nu uh, man.. I didn't read everything, but enough..

There's no way I would 'take them off the shelf' nor 'send back' to the lucky chair owner. These items are hers to do with as she sees fit =x

Some people just like to give others a hard time.

I completely understand your dismay at finding these objects which you gave to me for free (and neglected to fix permissions on) for sale at my yard sale, and apologize. You might be please to know that I have now removed the prices from the items and will be giving them away for free.

I agree with another post .... She should send them all back to the person who owns the chair.

so, how about someone who has one of those rare mac donalds happy meal collectables from japan... and sells them on Ebay...
(trust me i seen many hello kitty thingies)
they should really be sending them back to ronald when they dont want them anymore?

a yard sale is just that... getting rid of stuff you dont want..
opening a shop and selling just the womans freebies is tasteless tho.. but not a violation.

I received an IM yesterday, telling me that someone was reselling stuff. The person who IMed me was also someone whose stuff is being resold. I went over and there were 2 store owners in the same boat, and I was the 3rd there.

The other 2 didn't like it at all, and said that the person should indicate that it's a reseller shop. I have a sign in my store, saying that it's ok to buy and resell at a markup, so it was fine with me. But what got me was my bed being sold for 100L. It's in my store as a freebie. I don't approve of that.

The dresses of this thread may be being sold in the store where the lucky chair is, but whether they are or not, they were not exactly freebies. They were given as a reward for being on the parcel, and adding to the traffic - just like camping. A true freebie is something that you can just go to a place, pick it up, and go away. Most lucky chairs don't give freebies, imo.
