Noticed that too.. personally I think the plaintiffs are on drugs... I can understand the concept of copyright infringement here (although I agree that 'taser' has become pretty much common use as a word, so they might have lost that right anyway), but what drugs is LL supposedly selling?

To set the record straight, it was a reality show about cops called Armed and Famous that first brought up the sexual side of tasers, it sparked some controversy...

in japan the only ppl who sell tasers are adult shops or online stores that sell sex stuff and date rape drugs.

More than likely the bringing up about 'sex and porn' is an attempt by the lawyers into shaming LL into going for an out of court settlement, rather than having it go to trial and having all this 'naughty sex stuff' come to the forefront during it. It's a often used legal tactic. However at this point I'm not sure if LL would really care. What's one more blurb about sex in SL at this point. If it does go to trial, I think LL does stand to lose solely on the basis that such content existed and wasn't removed. The 'sex and porn' part is immaterial.

They will feel really dumb when they realize LL sells nothing except hosting for 3D chat rooms.

It's all very silly but there are lots of clever lawyers about and there's a growing industry of looking for things to sue people over. But its sooooo silly!

I wouldn't blame LL at all if they get their lawyers to look for something to counter-sue this Taser organisation over.

It's pretty amusing because some of the names have already left Linden Lab, and they are treating XStreet as a seperate entity when it now in fact is owned by LL. Seems they just decided to name anyone and everyone even remotely possibly responsible, which is wise as it's common for cases to have merit but be dismissed because the wrong party was named.

Trademarks of product/brandnames are also phonetically registered in most cases. besides the typograhical logo's, colorschemes, image based logo's. and in case of products/services the workings/functions/usabilities etc. In this case the electric "bullet" mechanism and such in relation to the shape of the product.
If they want to have a total block of the function/workings used by other producers, then they should have patent it.

But, the main thing is: if two companies use the same product/brandname, it's allowed to both have them register it as trademark, IF and ONLY IF, they are NOT in the same branche (competition) active.

E.g. SUN (tm) (producer of cleaning goods) and SUN (tm) (builder of server technologies and software)
Both use the same name, but are not in conflict, so it's approved.

Anyway, ontopic:

If the products inworld are using the same logo as the real brand, and the models are similar in shape/color/function as the real product, then they are against the trademark laws applied to the real firm. Meaning, the creator of the clone product is in debit.
In this case it's mainly the person behind the avatar, but since LindenLab(tm) exploites the SL platform on which this product is usable and puchage-able, their the first to write. Taser International (tm) has no direkt access to the persons RL data, associated with the avatar responsible for putting this clone product on the virtual world.
All LindenLab(tm) can do is forward the lawsuit to the person behind the avatar, and block the avatar direktly and remove the contents on which this lawsuit is based.
If LindenLab(tm) chooses to protect this avatars RL identity, then their also guilty in not cooperating in a lawsuit issue.

edit: it also depends what global coverage the trademark is based. (worldwide or just America (southern/mexico/usa/canada/greenland) and/or EMEA, and/or asia.

Not sure what suit working for Taser International greenlighted this legal action, but they need to re-evaluate their attachment to reality. And anytime I see a weapons firm complaining about pornography, pfffffft.
