From: Arielyn Docherty If I call my line of furniture "Prim Savers", or call my furniture "prim savers" in keywords, that's not exactly using Phil's store for my own advancement. Assuming that Phil's store is called Prim Savers, then yes, you would be using his brand name for your own advancement.

I guess my point was, is the competition using the OPs name purposefully to gain traffic and sales?? If my furniture was "prim saving" and I thought I had somehow come up with the phrase myself ("Wow! It saves prims....hah! I'll call it prim savers furniture!"  , that's different than if I said to myself, "Hey, self! Wouldn't it help our business if we capitalized on Phil's 'Prim Savers' concept and used his name in our advertisements??" Not knowing the OPs business, it's hard for me to understand why other businesses would profit by putting HIS name in THEIR keywords, unless they had inadvertently called their product the same thing. When we were looking for a name for our line of builds, we checked every possible combination of a few words only to find that others had used them. If we HADN'T checked, and used one that someone else had, we would NOT be intentionally using the name to capitalize on someone else's success. (OK, yeah, it would be stupid not to check, but the OP doesn't make it clear if he used the name first or just used it and decided to claim it after the fact). Now that I've beaten that dead horse.... (Not that I talk to myself....not that there's anything wrong with that)

I think Lindal kidd has got it.
There was a case a couple of years ago where a german coffee shop was trying to stop an english coffee shop from using a logo because they said it was similar to theres. The judge said as the english shop had been using it before the germans trademarked it, they could continue to use said logo.
I think the same applys to you. You admitted it was being used before you had the copyright, so they have been using it longer than you. Although i admit there is a difference between copyright and trademark.
Is it that simple??

Please dont start on copyright or before you know it anyone who has an avvy, or object based on a character or item from a film or tv show will soon be banned from using it in sl....and Im sure that would be a further downer to sl users who are fans of a mass of different genres who derive great pleasure as I do using media related objects without any intention of harming anyones copyrights....

Great isin't it? Maybe i should have thought before posting this but it's very intresting You get to learn about the slimey side of business, the sleezy business owners It doesn't really effect me, it's just unfortunate to see how low some people will go.

Intellectual property, copyright, trademark law etc are difficult concepts for smart people to be able to wrangle. Someone that spells sense incorrectly is not likely to be able to cope.

Oh my mistake, was early morning when i was laughing at the replys here Don't go turning this topic into an excuse to take ur late nite tensions out on someone for misspelling a few words, just find another topic to post in.
Just trying to make a point on how some folks handle their business affairs in SL Does nothing for me but might teach someone else how to avoid these mistakes
or perhaphs have a few laughs reading the friday thread
