I personally think that any creator who sends a notecard telling someone to do anything regarding their products is out of line. A personal inquiry with the "seek first to understand" objective is much more respectful than a mandate blasted with a bazooka. If I were to OP I would very respectfully visit the creators main location, send ims in an attempt to meet with the person and discuss their concerns which is what the creator should have done in the first place.

Again, having been on the receiving end of some of this witch hunt - you are illegally doing xxx - crap, I believe we ALL need to approach each other with the goal of working together for the good of all. People need to realize that once they sell and item it belongs to someone else to with as they wish and any other instructions are requests, not a binding contract.

That sounds fine to me. Either somebody visits the original shop, or they visit a reseller who has bought the original from me (and so I have _already_ been paid).


I think it was Phil Deakins who said something similar, and really, it's good publicity for the original creator because if someone likes the item, they're more likely to look for who made it, not who sold it.

I always do this if I buy from a yardsale. I look to see who created it and look to see if they have their own shop. I tp there, look around and usually end up buying a thing or 2. IMHO it's free advertising for the original creator.

I had a very healthy chat with the store owner....very thoughtful and courteous and respectful....which is a good thing, since it's one of my favorite stores. I've been there so many times....I can navigate it, blindfolded....(I mean, before it rezzes :)

Speaking for them, to the best of my understanding...their issue is not with the copyrighting...but with their good name being used to drive traffic in the searches. They didn't want all their hard work on developing the business, to be "Used"...by others, for gain. Also...with wanting to be clear on customer service issues, and where the product originally came from.

My issue was with knowing who your best customers are....and that using their name was to describe and indicate Quality Resale items, as opposed to junk. I have been to my share of junk yard sales....and as Stephanie points out...it is nice to know what you are going to find there....before taking the time to go there.

I wanted another business owner to know that I actually "promote" their business with multiple purchases and referrals....and they understand that, now.

A friend pointed out what ArchTx pointed out...that if you have a used BMW for sale....you would certainly advertise it as a BMW.

We both discussed "Courtesy"....and how it effects each other as business owners in SL. A healthy, and non-hostile discussion with them....solved the problem.

They agreed that they would not be upset about me using their company name in the ads....as long as it clearly states these are Resale items...which I stated....and I do have Resale signs all over the store.

After our pleasant discussion....and they shared how they became business owners in SL....I have a huge respect for them....and will continue to purchase zillions of items in their store.

Great points you all made....it does get a tad complicated in SL sometimes...doesn't it?

Thanks, 3Ring...but the Store Owner handled it extremely well.

I was going to add about the "flow of money" in SL...and business owners cooperating, rather than competing.....

When I purchase multiple items at that store....then put them in the homes I sell....then, when the homes sell....I start another one....and buy more items....plus everyone who tours the home, can click on the item, and see where it came from....even if they are not purchasing the home....they got some decorating ideas, and will perhaps head straight to that store.

If I have a zillion unused items in inventory....might as well have them out on display, as resale....so that the purchase of those items will allow me to go buy more, that I may or may not use again.

So the lindens keep flowing for everyone.

Yes, there are those who have questionable business practices....but just as in RL....they won't last long. Karma is a B.

Those who give good service...and continue to run good businesses, like the store owner I mentioned...will continue to do well, whether they have to police questionable behavior or not.

Maybe I'm missing something here, but the original creator sold the items as transfer/sell. Usually this translates as a higher initial price tag. If I pay a premium for the right to resell a product (or not if you are giving these permissions for whatever reason), you are whistling in the dark if you think I won't mention the brand name if I resell it.

Seems to me the creator should set no transfer permissions if they have a problem with folks reselling the merchandise.

Wanted to add more, but I am straying toward being not nice.

as a designer and store owner I have no problem with folks using my name if they are reselling anything they got from me

I have been thinking of putting together a resell package, complete with small store and vendors etc

all in good time though hehe

glad it all worked out for you guys
