Funkfenomenon and Uvas, with all the respect you're wrong, you CAN NOT sell nothing from SL on eBay.

First, by doing this you violate SL TOS - everithing that's on their servers belongs to LL, not to you.

Second, you violate ebay rules and I can prove this.

Go to eBay web site and you'll find it:
Home > Help Topics > Rules and Policies > Rules for Sellers > Rules about Intellectual Property > Digitally Delivered Goods

Here's a direct link:
http://pages.ebay.com/help/policies/downloadable.html
..................................................................................................................................

"Digitally delivered items are restricted on eBay. In order to list digitally delivered items, the seller must comply with the following requirements:.....

The seller must be the owner of the underlying intellectual property, or authorized to distribute it by the intellectual property owner. Violations of this policy may result in a range of actions, including:

Listing cancellation

Limits on account privileges

Loss of PowerSeller status

Account suspension

Referral to law enforcement

Referral to the rights owner, with disclosure of personal contact information

Examples of items that sellers are not permitted to list on eBay:...
Online virtual game artifacts such as: game characters, game accounts, game currency or game items."
..................................................................................................................................
The question why ebay does not remove the listings that are clearly in violation is completely different, ebay is a double standard company that can not be trusted , if something makes them money they'll pretend they do not see it, sometimes even when it's reported to them. These practices opened eBay to scammers, scared buyers and hurt good ebay sellers, this place SUCKS!

"Which would put them at odds with sites like SL Exchange which also caters to buying and selling a whole range of virtual products and services outside of Second Life "

I'm absolutely sure SL Exchange has the authorization to do this.

Well Mia, then please explain the recent auction of the Amsterdam Sim on ebay? Not to mention several islands and other properties currently up for auction.

SL items and property are about the ONLY virtual world items ebay seems to allow on their site. Maybe it's because they have a financial involvement with SL. Look at the new SL land auction site, powered by ebay.

You are completely in error, Mia. When the ban on sales of virtual property was announced by eBay, it *specifically* noted an exception for Second Life items. The reason behind this is that Linden Lab has explicitly given us as residents the rights to our intellectual property in SL. Therefore, the passage you quoted that says "The seller must be the owner of the underlying intellectual property, or authorized to distribute it by the intellectual property owner," covers the sale of SL items on eBay.

Daniel Terdiman's story at http://www.news.com/8301-10784_3-6154277-7.html gives the details:

eBay to exempt 'Second Life' listings from virtual items ban

Posted by Daniel Terdiman
Despite eBay's decision, as reported by Slashdot, to de-list any auctions for items from virtual worlds and online games, the company now says it will specifically exempt Second Life from that policy.

eBay spokesman Hani Durzy told CNET News.com Monday that that exemption stems from the auction giant's interpretation of what Second Life is.

"If someone participates in Second Life and wants to sell something they own, we are not at this point proactively pulling those listings off the site," said Durzy. "We think there is an open question about whether Second Life should be regarded as a game."

That statement should make Second Life publisher Linden Lab very happy, as it has tried for years to hammer home the point that its virtual world is not a game. But to have that position supported by as august an institution as eBay should definitely bolster Linden Lab's argument, regardless of what other observers think.

In the meantime, however, if you're trafficking in the virtual goods from other virtual worlds or online games, such as Ultima Online, World of Warcraft, EverQuest or any other, watch out. The eBay auction scissors are coming.

Hey, Maximillian, thanks for reminding me that ebay founder is a LL investor too, lol, that may explain the special treatment but yet there's no trace of that on paper and I searched everywhere ( magazine articles do not count :p ).

Yes, we have intellectual property rights BUT for me there's a difference between say the design of your dress and the dress itself that is just data on LL servers= their property. You too give LL the right not only to use your product whenever and wherever they like (exclusive license) with no compensation for you, but they have the right to delete your product with or without a reason. You can not even save the product on your own computer (which would give you too many rights ;) ).

Selling the product on other sites depends on their own TOS and I guess special agreements with LL. BTW I'm really curious what "intellectual property rights" do you have when you sell SL land and currency?

So here comes my question: with these a bit strange intellectual property rights can I sell my product from my web site?
