My lawyer is currently issuing Subpeonas against 3 US based sites for details of the originator of erroneous DMCA's and slander because details of my counter claim were freely passed on to the originator.

My original post was merely pointing out that the DMCA isnt the holy grail that people seem to think it is in the context of infringements.
Well good luck with your efforts. If someone passed your information out, remember that ip addresses are involved as well as other identifying information about the originators computer. If you have "an attorney" you are paying him or her a lot of money I imagine. That seems silly when you can go to your local law enforcement agency and let them know you are being harrassed online. That is where it starts. They handle it for free. So why then do you need an attorney?

If I call an attorney right now and tell them what you just told me, the first thing they will ask me is if I notified the policia. The police have detectives who handle internet crime. If you are paying an attorney, he is ripping you off.

Funny. How could you then prove that it was that person who did this? What are the sites? The judge would subpeona the sites for the IP addresses that posted the information. They would also check your computer and the other persons computer for evidence. So say bye bye to your PC for a while if not forever.

If the info doesn't add up to your claim or even worse if they found that you lied and it was YOU who posted the info you're screwed. I know al this b/c my ex tried this shit with me. She lied and said I posted up naked pics of her as well as death threats on some sites. I neve did any such. My pc, her pc, my mother inlaws pc and my sons pc was confiscated. I went to jail, my son went to foster care andwhen the judge found out she was lying, she was fined $25,000 (for all the trouble the judge sais that their staff had to go through to obtai the data) and sentenced to 6 months in jail for fraud, falsifying documents, and misleading law enforcement.

And using an anonymous proxy aint gonna help ya...she tried that and they subpeonaed that shit too. LOL

I'd love to see the sites too. I highly doubt anyone in SL filing a DMCA would post personal info on another resident. They would risk getting kicked off the game wouldn't they? IM me the sites. To me, it sounds like you may be creating drama where there is none. I think you should relax. I don't know the details of your "bridge", but getting all hyper and worked up over this is not healthy.

What I find funny is that you claim to being harrassed over the internet and have hired an attorney instead of contacting the police. That I find hilarious. I wish I was that attorney...I sure could use some extra cash.

So what are the sites?

Correct, the counter claimer has to show up at the court if the original person decides to take it that there. ( AT that stage the odds are evened as the counter claimer now knows who the other person is)




You don't even have to show up for court for EVERYONE to know who you are. I use this site at work and you can query names, case numbers, and courts to get case information.

Also, I suggest that you not say certain things on this forum that may be held against you later if your situation goes to court. Just some friendly advice.

The other person might turn around and add to their claim that you falsely accused them if it's only one person who you are in litigation with, if it's more than one then you could be talking about any one of them. Then you'd have to prove that they were actually putting this stuff up about you on some sites.

It's very serious to accuse someone of something so serious. You can ruin someone's reputation and hinder their business and be sued for damages.
