Does LL let us use SL machinima commercially?

Well the title says it all. I know Linden Labs are machinima-friendly, but I can't find out what's the policy on people making machinima in SL and then profiting by it.
Anyone know?

IMPORTANT! Commercial usage

If your film is for commercial gain, you need to email Linden Lab Licensing so we're cool with it. We need to know:

1. What your film's about?
2. Do you own rights to content featured in the film? If not, do you have permission from the creators?
3. Link to your video so we can watch it?
4. Your real-life contact info?

Truthfully we all think that applies if you are, say, HBO, but not for us ants.

Are the model release civil laws applicable in VR the same way as in RL?

I can't see anyone in SL getting butt hurt over you making money from machinima captured in world. BUT... there is always that person(s)... they want to see how RL laws are applied to VR... they want that "quick buck"... So....

My only consideration might be having a model release form, but how many avatars can actually be identified without the name tag hanging over their head?
The same laws that are applicable to people also go for trade marked and identifiable buildings and goods in RL (AWM Mars pretty much covered this in his posts and seems to have a good grasp on LL's rights [none] to bring any sort of legal action against anyone not using a LL's trademark.)

Can a private SIM owner bring civil action against a machinima producer for using their SIM w/o permission? Very likely the answer is no but in rare cases maybe.
