HOW do I know if the image has a Copyright?
The image will have a small c in a circle, likely in the bottom corner. that label means do not duplicate unless you have the right to copy- Copyright.

WHAT if I dont see a Copyright?
to the best of my knowledge if its copywritten they will put the proper notification, if it isnt there, then the image is fair game to reproduce / sell.


This is not accurate. Under current copyright law in the United States, images are automatically protected by copyright, unless those rights are specifically surrendered and the image explicitly placed in the public domain. The copyright symbol indicates a registered copyright, but registration is not a requirement for copyright protection (though it improves your chances to prove that something really is yours).

Sharing images for free is just as much a copyright violation as selling them. Under current and pending legislation, you might be subject to criminal penalties in addition to civil liability for the unauthorized use of copyrighted material.

If you don't have an assignment of rights (or absolute certainty that the image is public domain), don't use it. It's really that simple.

Hi Pendari,

For me, purchasing the pictures doesn't seem important at all. Maybe a dumb SL comparison, but I've ridden the Spook House ride a load of times but I can't buy it, or many other things in SL.

I never saw your original display. I'm thinking of Anais Nin for some reason. Anyway, I'd love to see it.

And Arcadia, what about sharing only in the sense that others can "view" the photos and artwork? I would not be making them copyable. To me it seems no different than if someone where looking over my shoulder at my computer screen and I was sharing the image with them in that way. It is all kind of tricky in the wording though. So I'll continue to give thought to my plan of action.

As of right now, I'm planning on putting the gallery back up, and hope to start working on it this week! Thank you again everyone for your feedback! :)

This option was not necessary due to the first line I put in my post which states:

"Ok.. :o This poll is really only for those who would go to an Erotic Art/Photo gallery in the first place. If you would never go to one no matter what, then this poll isn't directed at you. :)"

I'm not a lawyer, just an amateur (some would say amateurish) artist. But my understanding of the law is that you can't place an image on public display unless you own the rights to that image, or permission from the owner. Buying a print doesn't automatically confer that right.

But there is a high concentration of talent among SL users, as well as a healthy appreciation of eroticism. Why not solicit for original works?

No matter what else I do, this is a perfect suggestion Arcadia! Thank you! :) I have added a listing in the classifieds as well as in my signature to look for artists in SL. /invalid_link.html

In actuality, this will combine two of my favorite things. Helping others and sharing things I enjoy! Thanks again Arcadia. :)
