Policy Clarification

Following the controversy surrounding the Upskirt Museum, I want to make sure everyone understands the policy with respect to taking pictures of other avatars.

It's pretty simple: please ask permission when taking pictures you plan to publish, and make it clear how they'll be used. If permission isn't given, please don't use the image.

Also, if someone changes their mind and asks you to remove a picture, please do so as a matter of courtesy. :)

I'm glad this has become an official policy. I'd hope, however, that everyone should consider it a common courtesy.

While most people would be happy to have a picture you snapped of them published, not posting private or embarrassing shots should be common sense

I often work as photographer in SL so the permission of taking is assumed, but I go the extra mile and ask for permission to display, publish, or retain as portfolio.

Ugh, I just read this. What a disappointment.

I don't engage in upskirt pics, but I've a project of candid snapshots of avatars that has been worked on for some time. I was planning on maybe doing an exhibit eventually, but it won't happen if it's dependant on every single (unwilling) participant's permission.

The intent was to hold the exhibition regardless of permissions. Mostly, the photos were of a silly harmless nature, but there existed the possibility that some might have objected to their photos being posted. Between a castrated project of "what's not objectionable to anyone" and none at all, I'll simply not post anything.

This is why I no longer offer Custom RL T-shirts with your avatar picture on it because the clothing you wear the texture on the background behind you or the tree texture may be in dispute and by Copyright law were I to use them for any personal gain benifit or profit. I would be severely punished with a lower fine starting at 20k US and for Multiple infringements goes up to a cap of $250,000US on collection of single Items.

Those shirts sounds like a great idea - could you modify your policy to only use photos taken against a white background and/or a disclaimer that any provided photos are the copyright responsibility of the person who provided the photo?

I used to offer them as dipicted on the site but not any longer as the venture has been a significant drain on my RL expenditures.

And this is all an overbroad reaction to the silly upskirt thing. If I take a photograph of you in front of McDonalds where the splendid restaurant is incidental to the photograph I don't need Roy Kroc's permission for the "texture". If I take a photograph of you in public in front of 50 people incidental to the photograph, I need not secure the permission of all 50 incidental participants. To beat a dead horse, I can even take a photograph of you in a Hermes dress and not need their permission; if I intend to use it in a multi-million dollar ad campaign, then prudence dictates I get Hermes permission but likely not if I'm going to sell a dozen portraits.

The RIAA/MPAA/Microsoft folks have tried to broaden the scope of Intellectual Property to a wholly unreasonable degree. That and our oh so litigious culture has caused people to not do perfectly harmless things in order to not step on someone's toes. I fear Robin's stated policy was a sledgehammer to take care of the fly of the upskirt folderol.

If I were Unhygyenix I'd run the exhibition and take my chances and respond to actual requests from actual avatars with credible reason for the snapshot to be taken down. But that's me.

Everyone has Permission to use pictures of me they take in Public as long as they mention it is me by Name.

I should add though, that due to a lot of people having issues with pictures of types of nudity being taken of them and being displayed without permission, I would say out of courtesy, don't put those out in public without permission. I just think that is the kind thing to do, not so much the "right or wrong" thing to do. Outside of "sexual" or "nude" photos, I don't think much of the community is going to mind. And if they do complain, you can always take down their picture.

Just my thoughts..

I was confused as to why in the last 2 weeks or so people had started asking me if they could take my pic instead of just doing so. I always figured it was quite in their rights to do so. Hah! (Though I suppose I never thought they could have been taking pictures of my cloaca... *shiftyeyes*)

Anyone got size 194 jeans? Er... asbestos-lined?
