This Supreme Court decision absolutely shocked me. And the 4 dissenting judges, apparently.
It's like... all those movies where big corporations are trying to force out small people from an area to develop it ... coming true! And private housing is the minor part of it! With this ruling, large businesses can essentially kick out small businesses. Gee, I'm sure it's REAL hard to buy out some of these local planning board officials, who are elected in elections where like 2% of the population shows up to vote ... =( _____________________

I'm hoping that this actually happens, not only to Justice Souter, but to all the Supreme Court justices that supported the stripping of land ownership rights from 'the little guys'.
America was founded on the premise that the government should not be too large that the constituents could not take it back. I see this action as taking a small chunk back, and just maybe those in power will consider the consequences of their actions for the sake of all of us. Who is John Galt, indeed. |

I thought of something regarding the new E.D. ruling: Say your municipality is now trying to take your land for another private individual citing more revenue for the town...etc. How about hiring a lawyer, a land appraiser, and an expert on business growth in your area...and fight it out? Hire the appraiser and the business expert to located every other property in your area that could possibly earn even a penny more a year annually in tax revenue than yours, should the future private interest select that property over your own. Have the lawyer file a suit in your local court citing unequal treatment..there you have it (Why would they still want your land if you have provided better alternatives? They must be specifically coming after you, a poor little landowner!) If the whole onus is taxes, and you provide "another" place that would garner even more taxes...like say, the local private golf club, properties in the "exclusive" sections of town, beside City Hall, or any local elected official's residence. The more the merrier, because the municipality's lawyers will have to investigate all of them (something that could tie up litigation for a bit)...Now that the case isn't simply a municipality trying to gain more income using E.D., and has become a case of unequal protection again; you may even see different inroads to the higher courts in your state due to the "unique" nature of your claim. You won't be arguing that what the city is doing is wrong per se, you will be "helping" them make a better decision on where the most tax profit will gained...like if they chose to develop over the Mayor's house. |

I dont think I have ever seen such agreement on these forums on any issue.
So I'm going to up the ante a bit. I think those of us who believe in this project ought to help the town of Weare, New Hampshire realize the economic boon this Hotel will bring. I am looking into finding the name and mailing address or fax numbers for the 5 town selectmen. See, I have never ever had any reason to want to visit New Hampshire. Well, now I have some tourism dollars to spend and would love to spend them in Weare, New Hampshire, as some of you also do. If I am success in locating the contact info, I will post it here so we may all lobby the 5 selectman and let them know how much our tourism dollars will mean to Weare, if only we have the appropriate place to stay.
