prim limit for vehicles and physics

Just wondering about the effects of avies sitting on my vehicle after physics is turned on. If everyone sits before the driver sits, then I get a script error about the prim limits and not being able to enable physics. If I enable physics after I'm seated and then passengers are seated, I don't get the error. The question is not about the error, so please keep reading.

I could disable the ability for anyone to sit until the driver is seated. But I'm concerned that while possible I might be doing something that causes SL to go wonky. Let's say my vehicle is at 29 prims + driver. If everyone one sits (there are places for 5 passengers) my prim count would be 35 which is well over the limit.

If passengers sit down after physics are enabled, I would be pushing a vehicle that theoretically has 35 prims. It is possible to do so and the vehicle is drivable.

I've searched and everywhere it says you have to take into account your passengers in the 31 prim limit. But they give no reason why and in my scenario more that 31 (including passengers works).

What is everyone else's experience with passengers taking the vehicle over the physics limit?

Physics cannot be enabled on something that is more than 31 prims (including avatars) Physics do not become disabled if the object exceeds 31 prims...it just cannot be turned on.
