Why not have an option for a script to check the sim for how many avatars are present.

If the number is too high, say 20+ it could suspend normal functions and drop itself into a timer for 5 minutes and then check again. When it gets a result under 20 it could restart itself (And anything it's linked to). Causing the script to "play nice" under heavy loads.

This could have a significant effect on the "busy sim" lag effect if it were widely used.

Having an arbitrary number like number of agents would be less meaningful than having access to something like TimeDilation or overall time (ms) of agents and active scripts

I like your thought process, though.

Well, with getting the number of agents I was working from lowest amount of scan overhead for max return.

Why not bake this in as a constant for llRequestSimulatorData?
