Is this First Land or not?

There's a parcel of land that seems to have reverted to first land - it's owned by Ryan Linden now, and it has the tagline "Land For The Landless".

Someone I know wants to buy it, only they don't seem to be able to. They've got the right tier, they've paid to join, they say they've not bought anything else, but the buy option is still greyed out for them. They say they've had the option to buy on other parcels.

I don't want to give the exact location in case some land griefer type buys it and tries to charge me an exorbitant sum for it, but I'll PM any Linden who'd care to answer this. What I'm trying to establish is if this is really first land, if so why can't this chap buy it, and if not when can I expect it to be released for open sale?
