Can't Build :(

Hi, I have a 512 lot and a tree on neighboring lot is on line and taking up over 1/3 of my 512 lot. I've left him messages asking him to please move it, which he hasn't yet. It's a linden tree. I've placed a 10x10x10 red box beside it on my lot and it goes all way thru it to other side in my lot. Could you please remove the tree so I can build there? My lot is Paranthrene 244.575, 5.189, 143.631....you'll see the big red box. Thank you for your help.
