This should be in off topic, but I'll help you anyways.
Is it connected to your computer? If so, you need to unmount it. If you are using a PC, go to my computer and right click on the iPod and select unmount. If you are using a mac, just click the arrow next to it in the Finder window. If you have iTunes open, you can click on the eject icon in the lower right hand corner when you have the iPod selected.
If you are not connect to a computer, Toggle the Hold switch on and off. (Slide it to Hold, then turn it off again.) Press and hold the Menu and Select buttons until the Apple logo appears, about 6 to 10 seconds. You may need to repeat this step.
The select button is the middle button.
Hope this helps.
BTW, they first came out in October of 2001, is that when you bought your iPod?

From: Bladez Steele I hear the batteries for them only last 8 month. I've had my iPod for over a year and the battery is fine. -Ghoti
