O'Connor serves as a moderating influence and a bridge on a court that is divided along ideological lines. If an immoderate justice replaces her, the dynamics of the court could get ugly.

It throws a curve at all the groups on both sides who were gearing up for battle when Rhenquist retires.

Bush could surprise everyone and nominate another moderate conservative to replace O'Conner; a well-respected jurist more interested in the law than grinding partisan axes. Such a nominee could win quick approval with a minimum of acrimony and political posturing.

Any bets on that actually happening?

Bush will nominate a hardcore anti-abortion pro-funademantalism christian partisan. When Rhenquist goes in the next year or so he'll nominate another one.

I'm not sure it's quite that dire yet. While Rehnquist is a pragmatist willing to listen to reason, he also leans pretty far right. I'm not sure replacing him with another right-winger means any real change in the status quo. Losing O'Connor's moderate seat hurts more, but with Kennedy as a moderate swing vote, neither conservatives nor liberals would have an unassailable majority.

Wow - I'm so sad to see this, of all the Justices; I admired and respected her the most. With regard to who will be appointed to take her place, unfortunately, I agree with Chip. The right wing fundamentalists have been salivating for just such an opportunity and I doubt that Bush will disappoint them. Particularly with his ratings so low.

*grins* I know it won't be as dire as I said. And probably even if it was, I'd feel the need to stay where I am to be a dissenting voice no matter the consequence. But it's nice to dream eh? :) (see, practicing those ehs)

Hmmm. Do you think his rating would gain a boost from nominating a polarizing Justice? Personally, considering that Bush actually wants to get things *done* this term, I would think he'd be smart enough to nominate a moderate candidate for O'Connor. If he tries to pack the Court with right-wingers, just watch as the Congress slows down to a crawl while the political war rages over it.

Of course, bullies are not known for their diplomacy... :( And this particular bully does seem fond of war.

Personally, I think murder trials need more humor in them. Maybe we could have a Court Jester who makes fun of the DA behind his back. :D

I do think his message was appropriate. In an age of people who think they can push things thru the law based solely on their fame, it's nice to know there are judges who will forcibly remind such people that they are not intimidated by their celebrity, money, or status.
